The driver disagreed and appealed the fine to the Vologda District Court, explaining that he used the phone at the bus stop and not while driving. The judge upheld the fine and decided that the inspector acted legally and had no interest in the case.

Subsequently, the driver filed a complaint with the Vologda Regional Court and provided details of the calls, revealing that he was not on the phone at the time.
Taking into account the details of the appeals, the judge reversed the decision of the lower court and terminated the proceedings.
However, courts do not always accept details as irrefutable evidence of the driver’s innocence. In another case, the judge found that the driver could not call, but could, for example, read the message, and refused to comply with the claim.
