Only with an inspector: drivers were forbidden to go for a medical examination themselves


If the inspector of the traffic police has demanded that he go with him to the doctor in a patrol car, the refusal is equated with the refusal of the medical examination in its entirety. The driver therefore runs the risk of losing his driver’s license.

As explained by the First Court of Cassation of General Judiciary, it is the traffic police officer who determines the procedure for the driver to the place of the medical examination for alcohol.

“Current legislation stipulates that the procedure for going to the place of medical examination is determined by a traffic officer authorized in the field of traffic,” the court ruling said.

In other words, it will not work, for example, to go to the medical center by public transport or by car of a friend who came to support.

The Court of Cassation previously explained that the driver also has no right to choose the place of the medical examination.
