Sentence #1. “Give me your protocol…or resolution…what have you got there”
With such a sentence you indicate to the inspector that you do not understand basic legal matters. It is also necessary to understand how a protocol differs from a resolution in order to know the procedure for issuing fines and to be able to protect your rights. Not everyone has had a legal education, but a minimum of knowledge is always useful.
So the protocol is a document that is filled out by a traffic policeman in case he sees a violation in the driver’s actions. The protocol is not evidence of guilt (in fact, it is a statement of the inspector’s position. – Remark. ed.), it serves as the basis for the decision. The protocol drawn up is sent to the judge or other official authorized to deal with cases of administrative violations. After consideration of the protocol by an authorized person, a decision is made, a kind of verdict – the driver is guilty or not. You must appeal the decision as this is the final point in the dispute with the inspector.
Sentence #2. “Do you know who was stopped?”
This expression has long been winged. But even with solid connections, it’s highly uncivilized to brag about it and raise your voice. It should be taken into account that the inspector sometimes has to hear this several times a day. By the way you pronounce this phrase, he is very capable of determining if you really are who you say you are. Attempting to pressure a traffic cop with your authority will inevitably lead to a full check of the car and its owner.
The lawyer’s opinion
Elisabeth Vladimirova, Lawyer of the Legal Center “Man and the law”:
– Probably every traffic cop has heard this expression at least once in his work. It is important to understand: when stopping a vehicle, the inspector cannot predict who is inside. But he has rights and obligations established by law. Therefore, you should not answer rudely and abruptly – the inspector is just doing his job.
It is difficult to predict what the consequences of such aggressive driver behavior will be. In the worst case, despite all the “connections”, you can be held liable Part 1 Art. 19.3 of the Code of Administrative Offenses of the Russian Federation “Disobedience to the lawful order of a police officer” and placed in a temporary detention facility until all circumstances are clarified.
Sentence #3. “Understand me, I’m in a hurry…”
The continuation of this sentence can be different. For example: “I urgently need to go to work / to a meeting / to the airport to meet my partner / child to pick up from school.”. It doesn’t change the essence. This phrase is uttered in the hope that the traffic cop will enter your position. The inspector is also a person, he may also have a family and children. But the driver’s calculation will most often be wrong: the inspector immediately understands that you do not want to waste time on him. What could this mean for you? If a dishonest traffic police inspector comes across, he can turn the situation in his favor. For example, you may be asked to sign a refusal to undergo a medical examination. And it’s not just a hefty fine. You can also lose your driver’s license.
The lawyer advises: the most correct behavior in this situation is to express willingness to comply with all the formalities provided by law with all your appearance.
And further. If you believe that the traffic police inspector is overstepping his authority, please contact the Department of the Interior hotline at toll-free: 8-800-222-74-47. Tell the hotline operator the time, place, and other circumstances of the incident. The traffic police successfully fights unfair practices of inspectors. And every year there are fewer and fewer such cases.
