Today, the anti-corruption examination of the amendments to the Code of Administrative Offenses is ending, which will allow drivers to be punished (by deprivation of their rights and a fine of 30 thousand rubles) not only for the use of alcohol, drugs and psychotropic drugs, but also for substances found in urine or blood that are part of a number of commonly used medicines.
Previously, courts sometimes punished citizens even for small doses of phenibut, phenazepam, antidepressants, but then the Constitutional Court ruled that art. 12.8 of the Code of Administrative Offenses can be interpreted ambiguously and forced the State Duma to adopt clarifying amendments to the Code. The Ministry of the Interior took up the drafting of the amendments.
In the amendments being prepared, the police intend to oblige doctors who perform a medical examination of a driver to focus not only on the results of tests, such as with alcohol and drugs, but also on the clinical picture. That is, the conclusion whether the driver is drunk or sober, the doctor will make on the basis of a comprehensive examination.
The procedure and characteristics of the medical examination should be determined by the Ministry of Health, an explanatory note to the bill said. Clinical signs of intoxication – blurred speech, redness of the face, stability in the Romberg position, hand tremors, etc. – were taken into account until 2008, then doctors began to focus only on test results. If two expiratory alcohol tests with an interval of 20 minutes gave a negative result, there are no claims against the driver. Now it has been decided to return to the old practice.
There is still no list of banned substances and their concentration in the amendments. The Ministry of Health believes that “the problem must be solved”.
What’s the difficulty?
Doctors say that it is certainly necessary to take into account the “clinical picture”, but it should be understood that in the past, when this technique was used, the qualifications of doctors were higher than today.
As for the effect of drugs on the ability to drive, there are now so many drugs that there will be an enormous amount of work to be done in terms of time and volume. And the existing recommendations in the instructions are not enough.
