Who is responsible if Was the car damaged by an avalanche from the roof? This question was answered by a lawyer, chairman of the Moscow Housing Union, Konstantin Krokhin.
If the management organization cleans the roof and observes all safety rules, the blame falls on the car owner who parked the car, despite the warnings of the management company employee. It must be down at the house, from the roof of which snow is cleaned. With proper tuning, residents will be notified of upcoming roof cleaning, warning tapes will be installed, and utilities will be given walkie-talkies to stop cleaning if it poses a danger to pedestrians or property.
But if the melted ice fell because the roof or balcony was not cleaned at all, then it may be the fault of the management organization or the owner of the apartment, who does not clean the balcony.
“If the management company does not remove ice and snow in time, and there is a descent from the roof, from the roof of the house, that is, common property, and if a causal relationship is proven in court that the owner of the car has not violated anything, the management organization will be responsible, ”Krokhin explained.
In any case, it is better to place your car in such a way that there is no risk that something from the sky could fall on it.
