When drawing up the protocol, the traffic police inspector can offer the driver to enter the patrol car. Most of the time we agree, although many legally savvy citizens like to repeat that the driver doesn’t have to do this at all.

For example, they advise you to answer something like this: “Draw up a protocol, then I can sign it on the street.” Why is this done and what are the consequences?

Expert opinion

Sergei Smirnovlawyer:

– The driver is really not obliged to get into the patrol car. However, if the inspector has started drawing up a violation (drawing up a protocol, giving explanations, making decisions, etc.), the driver can be asked to perform certain procedural actions in the passenger compartment of the official car. And it is to ask, not to oblige. The current administrative regulations of the traffic police do not offer inspectors such possibilities.

From a legal point of view, the refusal to visit the salon of a company car cannot therefore serve as a basis for arriving at administrative responsibility.

However, now all police officers’ service vehicles are equipped with video recorders, and this is a guarantee that they will communicate politely with the driver, explain to him the article of the Code of Administrative Violations that he has violated and all his rights. In addition, no one dares to hint at bribes under the camera.

Communication with traffic police officers on the road is very common, even for a law-abiding driver. What to say about offenders. Refusing to get into the patrol car makes no sense: this is to some extent a provocation on the part of the driver and will only slow down the registration process.

It is much more reasonable to accept the inspector’s offer and get into his car, where it will be more convenient to draw up, read and sign the protocol, and the driver himself will be under the reliable protection of video cameras. Ultimately, you save time.
