“According to the law, if we work with an official representative of a company that produces a specific product, for example, a car, this person has no right to refuse warranty service to the buyer. But in this case, everything is complicated by the fact that, according to the documents, the manufacturing company does not officially sell any car to the buyer! And he did not even import it into the territory of the Russian Federation. “This was done by some third party,” he explained.
Moreover, if the car was purchased from the dealer and the buyer does not know that it was imported through parallel import, he can file a lawsuit against the dealer in case of refusal of warranty service. However, if the salon itself does not provide repair services, the court will oblige the manufacturer to undertake it. It is unlikely that a manufacturer based in China will comply with this requirement.
The expert noted that this problem could be solved if parallel imports were made legal in Russia.
“The Consumers Union applied to the Government with such a request and proposed a change in the law that would require the seller to return the money to the buyer if a defect was detected in the goods sold. “But unfortunately, this initiative has not found support yet,” he said.
