The Federal Customs Service of Russia (FTS) has recorded a large number of cases of undervaluation during customs clearance of cars imported from the countries of the Eurasian Economic Union (EAEU). This was reported to socialbites.ca in the press service of the department.
“There are issues with underestimating the cost of cars. Customs authorities are identifying cases in member states of the Eurasian Economic Union, which reported that cars showed signs of misinformation about their value, an official representative of the customs administration told socialbites.ca.
The interlocutor in the Federal Customs Service noted that the phenomenon of price manipulation by the customs authorities of the countries where the declaration was made, appeared after the goods went into circulation. Since the declarant is responsible for the inaccuracy of the information, those who try to cheat will still be punished.
“In such cases, all customs payments due will be collected from the declarant in full in the EAEU countries where the cars are customs cleared.”

The car can be taken
All risks follow the goods at customs, so for the buyer of a “problem” car, the principle of a bona fide buyer will not work, says Wilhelmina Shavshina, expert at the Customs Policy Council of the Russian Chamber of Commerce and Industry. “In the most conservative scenario, the car will be confiscated if administrative proceedings are initiated under Art. 16.21 of the Code of Administrative Offenses of the Russian Federation (illegal use, purchase, storage or transportation of goods).
It is illegal because customs payments between the borders of the EAEU member states were not paid in full from them,” the interlocutor explained.
The sanction of the article for legal entities threatens with confiscation and an administrative fine up to twice the value of the goods. Denis Migal, founder of the Fresh Auto automotive market, complicates the situation by the fact that it is very difficult for a buyer to determine the true primary cost of a car.
“If the incomplete declaration is not critical, sometimes not, then it will be difficult to identify it and revert such transactions.
In general, any parallel imports are not very secure and transparent because the car is purchased from individuals, it is not clear how mutual settlements take place,” Migal stressed.

Car dealers and business participants interviewed by socialbites.ca said that a scheme underestimating the true cost of vehicles is implemented not only in Kyrgyzstan, but also in Armenia, less frequently in other EAEU countries. According to Dmitry Rogov, founder of RogovMobil (expert in turnkey delivery of cars from South Korea, Europe and Japan), unscrupulous sellers can triple the cost of a car to reduce customs duties. As a rule, it is most advantageous to do this if expensive cars are imported.

According to the reporter, there is a certain “grid” through which cars are passed through customs. If you declare a car that the cost is much lower than this “grid”, then there are risks associated with the subsequent cancellation of the vehicle structure safety certificate (SBKTS) and vehicle passport (PTS).
The Russian Association of Automobile Dealers (ROAD) does not ignore that there are violations in this regard in Kyrgyzstan, they are more loyal to the transparency of customs duties in this country, ROAD noted. True, all violations relate to the gray zone of the market – high bids, unofficial and other private sellers, the association assured.
