Parallel imports of cars plunged into the gray zone

Previously, most imported cars were brought by legal entities – these were official distributors of foreign brands. Now the trend has turned towards individuals.

The fact is that various types of documents are issued for cars imported into the country to confirm their safety and compliance with the requirements of the EAEU technical regulations.

For some brands it has become impossible in 2022 to obtain a standard TS type approval (OTTS): OTTS is only issued with the permission of the copyright holder.

Subsequently, the Council of Ministers simplified the procedure: now private individuals can issue a design safety certificate (SBKTS), and a legal entity can issue a conclusion on the assessment of single-car vehicles (ZOETS).

SBKTS can be obtained from many laboratories, SOETS is only issued by the US.

It turned out that it is easier and faster for dealers to buy private cars – the customs clearance procedure is simpler and the costs are lower.

The National Automobile Union believes that the use of such a scheme leads to parallel imports into the gray zone, and that the dealers themselves are thus evading the tax.

There is another point of view: the importation of cars through citizens is absolutely legal, if customs legislation is not violated. Because the concept of “car dealership” in Russian law is not.

A problem for buyers may be the SBKTS recall. Rosstandart regularly checks the laboratories that issue accreditation, and if it turns out that the machine does not actually pass the test, the organization’s certificate is withdrawn. But nothing prevents you from getting it later in another laboratory.
