An unexpected legal precedent has been set. A broken rented scooter collided with a parked car in Tatarstan. The Supreme Court of the Russian Federation ruled that the rider, not the owner of the scooter, was responsible for the accident.
After the perpetrator of the accident flew into the car in the parking lot, the owner of the damaged car went to court to pay for the damage. The first court agreed with the position of the traffic police: the scooter driver paid a small fine for driving with a faulty braking system (part 2, article 12.5 of the Code of Administrative Offenses of the Russian Federation).
The Supreme Court of Tatarstan overturned this decision and removed the driver’s sentence, as the circumstances of the accident were not proven. But the owner of the scooter was punished with 180 thousand rubles, which she had to pay to the injured car owner.
Only after that did the case reach the Supreme Court of the Russian Federation, where the blame was transferred to the scooter driver. From the position of the sun, it was the scooter in charge of the transport as it headed straight for the parked car.
Unfortunately, this is not the end of the story. Now the case has been transferred to the appellate court – the Supreme Court of Tatarstan.
