Sila International Lawyer lawyer Ilya Chicherov spoke about the possible consequences of the action of Khabarovsk Amur hockey player Alexander Khokhlachev, who jumped into someone else’s car. The expert noted that the fine currently imposed on the hockey player was determined by the internal decision of the club. At the same time, Khokhlachev can appeal this sentence if he thinks it is unlawful.
“Current labor legislation does not foresee a fine as a form of disciplinary sanction. However, taking into account the characteristics of sports activities, various sports provide for the possibility of reducing the wages paid to players due to certain circumstances.
This means that the club can set a small salary (paid in any case) and pay the rest (for example, achieving high sports performance, absence of violations, etc.). The bonus part can be much larger than the salary, which is a very common practice in football, for example.
The KHL has adopted rules regarding the amount of wages to be paid to hockey players: 60% of the total amount is salary, 40% is bonus. Standard forms of employment contracts are widely used here (a requirement of the KHL regulations): they also contain such a ratio. But we can only guess what order of payment of bonuses is available in HC Amur. To do this, you need to familiarize yourself with the regulations regarding bonuses and other local actions of the club, which, for obvious reasons, the general public cannot do.
Therefore, most likely, “Amur” is talking about deprivation of part of the bonuses, and it may be necessary to deprive Khokhlachev of bonuses for several months in a row until the entire monthly income is accumulated.
Maybe that’s why the club also made a statement about the possibility of canceling the fine – if the hockey player no longer commits such crimes, they will not fine him further. This issue is the responsibility of the club.
However, if a hockey player considers that being deprived of a bonus is illegal, he will have the right to appeal to the KHL Contract Disputes Commission. But I think this will not happen,” the lawyer concluded.
The incident occurred on the night of October 15 in Khabarovsk, after Amur lost to Kazan club Ak Bars in a KHL regular season match. Khokhlachev was walking with friends along the road, he saw a car, he ran and jumped on the hood of the car, then went up to the roof.
The management of the Amur club is investigating what happened, among other things, by checking the movements of other players, defender Viktor Baldaev and forward Vyacheslav Gretsky. It was noted that Khokhlachev did not throw a puck into the opponent’s goal for 11 consecutive matches. KHL and police also carry out checks.
