The Public Prosecution Service files a complaint against Luis Rubiales for sexual assault and coercion

It is the final step to promote the opening of criminal proceedings against the suspended president of the RFEF.

The Public Prosecution Service presented this Friday, September 8, 2023 the complaint in the National Court against Luis Rubiales, the suspended president of the Royal Spanish Football Federation (RFEF), for the non-consensual kiss he gave Jenni Hermoso during the celebration of the World Cup. The Attorney General’s Office has formalized its complaint, which Hermoso joined herself after filing a complaint with the Attorney General’s Office last Tuesday before returning to Mexico.

This means that the case ends up with the National Court, the goal that the Public Prosecution Service had set itself. Now the Court will instruct the process, as is customary in cases between Spanish citizens outside the national territory, and will have to decide which Central Court of Instruction will undertake the investigation. At the same time, the Court must decide whether or not to open criminal proceedings against Rubiales.

The investigation phase can last up to six months and the judge can decide to dismiss the case at any time. The next step is to set deadlines for the filing of charges, the prosecution and the defense, which has a deadline of ten days. A date is then set for the oral hearing.

While the provision for this offense includes prison terms of one to four years, the offenses would fall within the minimum range and the sentence would be replaced by a fine if the judge deems it appropriate.
