At the same time, the Court must decide whether or not to open criminal proceedings against Rubiales.
The investigation phase can last up to six months and the judge can decide to dismiss the case at any time. The next step is to set deadlines for the filing of charges, the prosecution and the defense, which has a deadline of ten days. A date is then set for the oral hearing.
While the provision for this offense includes prison terms of one to four years, the offenses would fall within the minimum range and the sentence would be replaced by a fine if the judge deems it appropriate.
