Rudkovskaya accused the builder Denis Gontar of embezzling 31 million rubles by publishing the date of birth, place and full name on the Telegram channel.
“I want to warn against giving your money to stray builders!
Taking advantage of the situation with the military operation, he attracted cash (he honestly earned 31 million rubles after taxes) to the trust for the construction of our facilities, on the pretext that funds are needed for materials and the banks are not working well.
The result – no materials, no money, not a single document, ”wrote Rudkovskaya.
The Baza Telegram channel also reported that in total Rudkovskaya was deceived by 130 million rubles, for having allegations against the company PSK MET KON, which is engaged in the production of metal structures.
“According to Rudkovskaya, Angela Plushenko LLC paid the company 99 million rubles for the contract, but the agreed terms were not met,” Baza said in a statement.
However, the manufacturer has not yet confirmed this information.
“We heard a bell, but you don’t know where it is! Lucky for scammers during a military operation! A good argument runs like clockwork: “Failures in the supply of materials and the operation of banks.” A little later about the second part! We are still solving it, ”said Rudkovskaya about the Baza news.
As for the fraud case, which has already been confirmed by the builder, Gontar, the builder, could be sentenced to ten years in prison. This was reported to socialbites.ca by criminal lawyer Maxim Kalinov:
“Gontar is liable for fraud on a particularly large scale, in part 4 of article 159 of the Criminal Code of Russia.
It is punishable by deprivation of liberty of up to ten years, with or without a fine of up to 1 million rubles.”
At the same time, the lawyer noted: it will be difficult for Rudkovskaya to convince the court that she really transferred 31 million cash to Gontar, and with competent protection, the builder can completely avoid criminal punishment.
“I am very often involved in fraud cases in practice and I can assume that it would be difficult to prove that the victims transferred the specified amount of money.
This type of fraud is considered a serious crime, but with competent protection, the court can impose probation for up to eight years.
Often, criminals understand that they can be punished, so they make advance contracts for the performance of any activity: in the case of Rudkovskaya, most likely, a civil law contract was concluded.
And if the police officers come to Gontar, “I made a civil law contract. Gentlemen, let’s settle the matter civilly through the court.”
That is, Gontar will insist that this entire case be considered within the scope of civil law in a court of general jurisdiction as part of a statement of claim. This automatically avoids criminal liability. Such precedents are very common.
If the police come back later, he will say to himself: “The decision of the civil court of first instance within the framework of the indictment is already available. I can’t have committed any crime.”
And even if a civil law contract is not concluded, in any case, Gontar can create in advance the appearance of the legality of his activities: for example, to purchase some goods for construction, etc. People often hide their activities so that obvious fraud is not seen.
In such cases, they often refuse to even initiate criminal cases.
With the right protection of Gontar and if he made a civil law contract, I am sure that nothing will happen to him,” he said.
Finally, the lawyer explained why it would be difficult for Rudkovskaya to return the 31 million, even if she wins the case.
“Recovering lost money is very difficult. Very often people come and say: “I have a decision in the framework of a criminal case – to compensate for the damage caused by the crime: one million.” And a penny is transferred, because the criminal has no property.
Gontar may have nothing to gain. Kalinov noted that he could even declare himself bankrupt.
– It is very difficult to implement the right to compensation for damage. Even a court order doesn’t mean anything. There is nothing to collect. And that’s it. I’m sure Rudkovskaya won’t take her money.”
