Seven years for extortion: MMA fighter faces jail time for blackmailing an underage child

Mixed martial arts (MMA) fighter Askhab Magomedov was detained in the hotel room of the Azimut Olympic Hotel in Moscow. According to RIA Novosti, the athlete is suspected of extorting money from a minor.

According to the information submitted to the investigation, in October 2021, Magomedov demanded a large sum of money from a minor, threatening violence, in exchange for the athlete not disseminating information that would embarrass his family and loved ones in the media. . As the Telegram channel “112” clarified, Magomedov forced him to pay about 600 thousand rubles, after earlier claiming that a minor sold his friend fake shoes under the brand name of a well-known brand.

After the calls demanding payment of the money, the young man’s mother went to the police and gave a statement.

A criminal case has already been initiated against the warrior. According to the article brought against Magomedov, he faces up to seven years in prison.

Magomedov’s previous scandals

It was learned that on May 17, 2022, the athlete had a conflict with security guards in a parking lot in Moscow. Having knocked over a cone, the fighter went around the barrier and without permission taxied to a parking lot near the Kazansky railway station. The security guards tried to show the driver his misbehavior, after which a fight almost broke out at the barrier.

A few days ago, on May 5, 2022, Magomedov was involved in a fatal accident. The fighter was in a Porsche Panamera with blogger Nekoglay. A car-sharing vehicle flew at them at high speed after passing a red light before, after which a Porsche was flown into a truck.

As a result of the accident, the driver of the car sharing the car died at the scene as he was stuck in his car and was seriously injured. Nekoglayu and Magomedov needed medical attention: the blogger suffered a concussion, and the athlete’s head was broken.

What punishment threatens Magomedov for extortion?

Criminal lawyer Maxim Kalinov said in an interview with socialbites.ca that if the accused is proven guilty, he will face a serious prison sentence.

“MMA fighter Magomedov is punished in accordance with Part 2 of Article 163 of the Criminal Code of the Russian Federation (extortion), which provides for a prison sentence of up to seven years and a fine of up to 500 thousand rubles or without it.

Magomedov’s extortion of money from a minor is not an aggravating circumstance under current penal code. The list of aggravating conditions is extensive.

The fighter’s position will not be aggravated by the fact that he extorted money from a minor, ”the statement said.

According to him, in this case, Magomedov must admit his guilt in order to be able to count on a change in the category of crime in the future.

“I have encountered such cases in practice more than once. As a rule, the investigation always has sufficient evidence of the guilt of the accused, therefore, when defending clients, I always choose the tactics of acknowledging the guilt, compensating the moral and material damage to the victim.

In addition, with such tactics, it is possible to petition the court to change the category of crime from “serious” to “medium severity” in accordance with Article 15 of the Criminal Code of the Russian Federation. submit a petition for the application of article 64 of the Criminal Code of the Russian Federation, which allows the court to impose penalties below the lower limit.

This tactic allows you to achieve suspended penalties and lighter types of penalties, ”concluded Kalinov.
