The SEJM committee for justice and human rights approved the candidacy of the law and justice MP Marek Asta and professor of Law Artur Kotowski negatively well as judges of the constitutional tribunal. Both candidates were applied by the PIS club.
In December last year, the conditions of three of the 15 judges in the Constitutional Tribunal: Mariusz Muszyński, Piotr Pszółkowski and Julia Przyłębska. In accordance with the regulations of the SEJM of candidates for the Constitutional Tribunal, he proposes the presidency of the SEJM or a group of 50 delegates.
Only MPs for Rights and Justice have submitted candidates for judges for the Constitutional Tribunal. PIS suggests that they would be PIS MP Marek Ast and Professor in Legal Sciences Artur Kotowski. Other clubs, Civic Coalition, Poland 2050 – TD; PSL and Links, announced that they would not submit candidates for the Constitutional Tribunal.

Nowadays, the SEJM committee for justice and human rights has been assessed by two candidates for judges of the constitutional tribunal presented by the law and justice representatives. After the votes had taken votes by both candidates, the committee immediately went to vote.
23 MPs participated in the vote on both candidates. 7 MPs voted for the positive opinion of the candidacy of Marek Asta, 14 were against. Remember two people. In the case of the candidacy of Prof. Artur Kotowski, 8 delegates voted for her positive opinion, 14 delegates were against and one person was abandoned. The applicant for the candidacy of MP Marek Asta was PIS MP Kazimierz SmoliÅ„ski, who assessed that he bought legal education and professional or parliamentary experience “justifies the presentation of his candidacy to the judge of the Constitutional Tribunal.” MP AST worked as a legal adviser and teacher. For fifteen years he was mayor of the city and the municipality of Szlichtyngowa, and from the fifth term of the SEJM he carried out the mandate of the MP.
The applicant for the candidacy from Professor Artur Kotomski was PIS MP Krzysztof Szczucki. Kotomski, is professor of Legal Sciences, and currently the head of the Department of theory and Philosophy of Right at the Faculty of Law and Administration of Cardinal Stefan Wyszyński University in Warsaw. MP SZCZucki pointed out that Prof. Kotomski has a deep experience in legal practice. He noted that he is, among other things, a member of the Supreme Court Studies and Analysis Office, a member of the main committee in cases of violation of the discipline on public finances and a judge of the exhibition bank at the stock exchange. He has been associated with the Supreme Court since 2009.
On March 6, 2024, the SEJM adopted a resolution on the removal of the consequences of the Constitutional Crisis of 2015-2023 and stated that “in the activities of the public authority of the Public Authority of the Constitutional Tribunal are issued in violation of the May Act Considered a violation of the principle of legalism by these organs, among other things, because of the SEJM -Resolutions with regard to the election of CT judges, which were taken in a gross violation of the law -Mariusz MuszyÅ„ski, JarosÅ‚aw Wymbak and Justyn Piskorski are not judges of the Constitutional Tribunal.
Since the approval of this resolution by the SEJM, the judgments of the Constitutional Tribunal have not been published in the Journal of Laws.
