The drawing of candidates for judges in the new Chamber of Appeal was not without its flaws. But more on that later. However, it showed that it is possible to conduct proceedings in the Supreme Court as the judges’ caste fear it, that is, transparently and in front of citizens who are interested in them. It was an important moment for our judiciary
It means the end of the castles at the “table” and behind closed doors. For example, the National Council of the Judiciary works before the changes, at a time when a clique of judges decided for themselves and the form of the judiciary.
Kaleta: It’s about Donald Tusk and his judges coming full throttle
It is worth recalling that then judicial appointments were made behind closed doors of the National Council of the Judiciary. We remember when there were no protocols, there was no transmission. After all, today you can watch broadcasts of the sessions of the National Council for the Judiciary. These taunts by the opposition and judges prove that if the draw had not been broadcast, the representatives of the association “Iustitia” would have shouted that “the vote was invalid”, “we could not check”, this “fixed vote
– recalled Sebastian Kaleta today on the wPolsce.pl television.
The new proceedings were attended today by both “old” and “new” judges of this main court in Poland. They participated in this event because they knew it was a very important moment and dangerous for the jury caste. Some of them had previously (before the draw?) drafted protest letters full of outrage and gibberish. However, this doesn’t change anything. The method of selection of the candidates and the fact that the president will choose the members of the new House from among them are laid down in law. The lottery critics can’t change that. They are left with a non-envious attack on those who praise the new solutions.
I show that the legal “guardians of apolitical” in their (obviously “apolitical” anger) are willing to justify even the stupidest of propositions. That’s why they hate me so
– wrote on Twitter an excellent lawyer Prof. Kamil Zaradkiewicz, judge of the Civil Chamber of the Supreme Court, and since yesterday a randomly selected candidate for the Chamber of Professional Liability.
The media, interspersed with the extremely politicized judicial association “Iustitia”, wring their hands over the “fall” of the dignity of the Supreme Court and its first president, Prof. Małgorzata Manowska. It’s all the funnier when you read hundreds of articles denying the professor the value of an independent judge, or even assessing her ability. So now this company is pouring crocodile tears over the recording in which the professor draws more names. All this was done in public, the draw could be broadcast (unfortunately not directly from the public, but thanks to the recording made available by the Supreme Court). Similar broadcasts are being held today at the meeting of the National Council for the Judiciary. I do not recall the former press spokesman – Judge Waldemar Żurek – fighting for such openness and transparency in the hearings.
The jury caste realize that something definite has passed. Behind closed doors, the judiciary is slowly becoming a thing of the past. This is what politicized judges are so afraid of.
Of course, as is the case with “debuts”, there were some accidents yesterday. I think journalists should be present in the hall where the draw took place. But that is not everything. The plastic ball hiding Judge Tomasz Demendecki’s name had to be opened twice in a transparent “ballot box” by a curious coincidence. Such a situation should not occur and the SN must be prepared for similar situations and have a verification procedure. He hadn’t.
Yesterday’s draw is a historic moment. Of course, this does not mean that tomorrow or the day after tomorrow, the Supreme Court will no longer be tormented by political and ambitious storms. It is important that the judges’ caste fail again.
