However, a broader consensus is needed to change the provisions of the constitution,” said MP Jan Mosiński in an interview with wPolityce.pl. The Law and Justice politician has no doubt that the current constitution allows over-interpretation and does not adequately protect important institutions against violations of the rule of law. In an interview for the weekly magazine “Sieci”, PiS President Jarosław Kaczyński announces extensive political changes following the overthrow of the coalition government on December 13.
It is very good that such a voice comes from a politician who is recognized, even among his opponents, as a strategist and an exceptional figure. I agree with his words, but it will be necessary to obtain a strong mandate from the voters and build a base of responsible young politicians. No one defends changes to anyone, but it must be done through a certain legal and constitutional order, not based on opinions, pseudo-decrees and resolutions. We must not forget that the Polish Constitution takes precedence over EU regulations and decisions of EU institutions

The state must be strong with the strength of its citizens. Since the coalition was formed on December 13, the state has forcibly imposed actions on citizens that are illegal.* The citizen is the background for those currently in power. This cannot be accepted
– says the Law and Justice MP, emphasizing that the actions of the current government are leading to the downfall of the Polish state.
These “contra legem” actions (against the law) have been carried out from the very beginning. We remember the attack on the media, which shut down public television signals, which reminds us of the time of martial law, when there was no Telerank. The breakdown of the justice system regarding various institutions means that the country is in ruins. The government is showing citizens that the source of law for them is not the constitution, laws and regulations, but legal opinions and resolutions, and now pseudo-decrees of Prime Minister Tusk. This must end once and for all
– states the United Right politician categorically.

The constitution must be changed. It was adopted in 1997 in a completely different political and legal reality. Even then it was not my constitution, I was a supporter of the citizen project of the constitution, which was endorsed by ‘Solidarity’ and a dozen right-wing political formations. Unfortunately, we lost the constitutional referendum and the current referendum was adopted. As a citizen and politician I try to follow it, even though it no longer fits in with current reality. It leaves room for many misinterpretations from those who wish democracy ill on the currently ruling camp of the December 13 coalition. They overinterpret what the Constitutional Court, the Supreme Court or the powers of the president are. The constitution must be changed. However, for this, Poles must give an appropriate mandate to specific political formations during the elections. President Jarosław Kaczyński repeatedly emphasizes that the constitution must be amended

Stronger protection of democracy
In an interview with the weekly magazine “Sieci”, President Jarosław Kaczyński speaks about the need to create a new institution that would protect the main state organs from violations of the rule of law.
We should think about including a strong mandate in the Constitution for institutions that guarantee compliance with the law. President Jarosław Kaczyński also mentioned the creation of the Council of State, a body with strong constitutional support that defends important state institutions. Such a body is necessary because today we see that the ruling majority has no respect for the rule of law and compliance with the provisions of the constitution.

It will also be necessary to form a new generation of politicians who understand these problems and who will take over the leadership of the state. If a political consensus is reached that takes the form of the framework required by the law, it has a chance to work. Unfortunately, since the formation of the coalition on December 13, the government in Poland has done everything it can to make the principles of democracy an anathema to its citizens. They interpret the law as they understand it. They are inspired by the few jury members who do exactly that. This is a very dangerous phenomenon for democracy
