We have to take decisions that will sometimes be questioned; I will take them with full awareness of the risk that not all of them will meet the criteria of a full rule of law from the point of view of the purists, Prime Minister Donald Tusk said.
Addressing the experts and constitutionalists present at the meeting in the Senate, he said that the executive branch, “without legal instruments,” “must find within itself the strength and determination (…) to take risks and make decisions that are sometimes questioned even by states.”
Somehow I will continue to make such decisions in full awareness of the risk that not all of them will meet the criteria of a full constitutional state from the point of view of, for example, purists, in the good sense of the word.

““Destruction of the system”
The last eight years have destroyed the justice system; we are drowning in ‘interpretative laxity’. We will often commit acts that, in the eyes of some legal authorities, are contrary to the provisions of the law
– said Prime Minister Donald Tusk.
The Prime Minister noted that the last eight, when Law and Justice was still the head of government, “destroyed” the justice system in Poland, and not even in black and white, because we are all drowning in gray areas, in these loose interpretations.”
In a sense, everyone has every right and privilege to express their own opinion on what should and should not be done, as opposed to the opinion of others. I am talking about personal discomfort in connection with co-signing matters

Tusk turned to the experts: “We are likely to make mistakes more than once or commit acts that, according to some legal authorities, will be inconsistent or not fully consistent with the provisions of the law.”
Nothing releases us from the obligation to take action every day. Every day I have to make decisions that can easily be criticized and questioned from a legal point of view. But without these decisions, it would make no sense for me to take on the responsibility of leading the work of the government

Tusk threatens himself
Prime Minister Tusk announced that in order to restore the rule of law, it is necessary to “act within the framework of a militant democracy”, which means downplaying the opinions of some legal authorities.
If we want to restore the constitutional order and the foundations of liberal democracy, we must act in terms of a militant democracy. This means that we will probably make mistakes or take actions that some legal authorities may consider not entirely in accordance with the letter of the law, but nothing absolves us from the obligation to act.
