The Provincial Administrative Court in Warsaw issued a statement in which it stated that the Provincial Administrative Court had received a complaint about the appointment by President Andrzej Duda of the Chairman of the Assembly of Judges of the Civil Chamber of the Supreme Court. However, the Provincial Administrative Court forwarded this complaint… to President Andrzej Duda, because this complaint must first be sent to “the body whose action, omission or protracted course of proceedings is the subject of the complaint.”
On 6 September 2024, the Provincial Administrative Court in Warsaw received a complaint against the Decree of the President of the Republic of Poland of 17 August 2024, No. 1131.18.2024, regarding the appointment of the Chairman of the Assembly of Judges of the Civil Chamber of the Supreme Court (resolution published in the Official Journal of the Republic of Poland “Monitor Polish” of 27 August 2024, item 799). Together with the complaint, a request was filed to suspend the implementation of the contested act

Complaint forwarded to President Duda
In accordance with the order of the President of the Judicial Division VI the complaint was forwarded to the President of the Republic of Poland on September 9, 2024. Pursuant to art. 54 § 1 and 2 of the Act of 30 August 2002, Act on Procedures before Administrative Courts (Journal of Laws of 2024, item 935) – a complaint to the Administrative Court may be filed through the body whose action, inaction or prolonged conduct proceedings are the subject of a complaint. The authority in turn forwards the complaint to the court, together with complete and orderly files and a response to the complaint, within thirty days from the date of receipt.

After the President of the Republic of Poland has forwarded the complaint, together with the response to the complaint and the administrative files, the Court will take further procedural steps in the case.
