Prime Minister Donald Tusk’s decision, which he himself described as a mistake, should not be seen as a halt to the restoration of the rule of law, Justice Minister Adam Bodnar said when asked about the co-signing of Judge Krzysztof Wesołowski. In this way, he had to defend his “boss” against the “disappointed” young people at the Trzaskowski Campus.
By decree of President Andrzej Duda, Judge Krzysztof Wesołowski was appointed chairman of the assembly of judges of the Civil Chamber, which must select candidates for the president of this chamber. Wesołowski was appointed to the Civil Chamber of the Supreme Court in March 2022 – and he was appointed to the Supreme Court in a procedure changed by the National Council of the Judiciary during the PiS government. In accordance with the regulations, the decree was co-signed by Prime Minister Tusk. Information about the acceptance by the head of government of Wesołowski’s appointment led to numerous comments from lawyers. There was a wave of complaints and anger from the so-called judicial caste.

Tusk admitted that the co-signing for Wesolowski was a mistake. According to the prime minister, the official who drafted this document did not notice the political nature of this appointment.
A statement is needed in a case that has especially angered the community of independent lawyers, all those involved in the struggle to restore the fundamental sense of the rule of law in Poland. I will not beat around the bush, I want to say very clearly that a mistake has been made
– Tusk said at a press conference.

“It really is a huge shame.”
The Minister of Justice was approached about this matter by a law student during a debate at the Campus Poland of the Future.
It is really a huge shame. I am disappointed with this decision. You promised the European Commission that we would restore the rule of law in Poland. And now we are legalizing all the changes introduced by PiS
– said a participant in the debate “The rule of law in practice”, in which the Minister of Justice spoke with European Commission Vice-President Vera Jourova.
He had to explain it to Tusk
The Prime Minister agrees that it was a mistake, but I would not want this to be misinterpreted as an end to the rule of law in Poland.

He added that “whatever happened, this situation does not absolve the government from the obligation to adopt regulations regarding the Supreme Court, the so-called neo-judges, including the National Council of the Judiciary.
He recalled the Prime Minister’s announcement to introduce appropriate bills within a few days.
This is also part of the action plan that has been presented to the European Commission. We are moving forward to pass this legislation in a way that will not be vetoed by the President
– he added.
That’s the problem. We will not complete judicial reform without a president who is willing to work with us. We are in a transition period. We are trying to do everything possible to make changes under the current regulations
– said Bodnar. As he noted, the status of the so-called Neo-Rights is one of the fundamental problems.
Tusk announced on Wednesday that Justice Minister Adam Bodnar will soon present three projects concerning: the status of judges, the National Council of the Judiciary, the Supreme Court; these legislative changes have already been prepared. “I believe that after the presidential elections (in 2025), the new president will immediately have these bills on the table for signature and we will be able to fulfill what we have committed to,” the prime minister added.
