Roman Giertych, a member of parliament from the Civic Coalition, presented his idea for liberalizing abortion legislation in Poland in an interview with gazeta.pl. According to the politician, abortion assistance should not be prosecuted ex officio, as is the case now, but after explicit notification of the woman who underwent the assistance. Giertych believes that the issue of decriminalization of abortion could break the governing coalition in the future.
In an interview for gazeta.pl, a politician from the Civic Coalition was asked about the recent vote on decriminalization of abortion. Giertych stated that such a project has no chance of being adopted in the current Sejm.
This lost vote on abortion was very important because we were counting on this vote. It turns out that the current Sejm will not be able to liberalize abortion legislation as the left wants. 14 PiS MPs were absent from the vote and the project was still defeated. Their entire club has 190 MPs, there are 3 MPs from Kukiz who are also against. We have 24 PSL MPs who voted against and 18 MPs from the Confederation. In total, we have 235 votes against. This means that such a bill will not pass in this Sejm. And it is not because of my vote, as some people suggest

According to Giertych, continuing this project “to completion,” as announced by the left, could in the future result in the collapse of the ruling coalition.
Towards a compromise that we will agree on and that will not change until the end of the term. If not, this issue will destroy the coalition sooner or later. No jokes here. We have to find a compromise. I am a believer, but I do not believe that everything should be punished by criminal law. In short, not every bad thing that someone does has to be reflected in the criminal code. I believe that there are possible compromise solutions that can be painfully accepted by the left, but also by parliamentary conservatives like me.

A woman’s decision
The Civic Coalition MP has his own idea to solve this problem.
Since in the compromise of years ago everyone agreed not to punish women for abortion, I believe that in the case of abortion up to the twelfth week, the method of prosecution can be changed and a provision should be introduced that complicity and incitement to this crime will be prosecuted only by the prosecutor at the request of the woman from whom she had previously undergone this abortion. Legally – in the case of an offense under Article 152 of the Criminal Code, the prosecution of a crime against a fetus up to the twelfth week of life is changed from a public complaint to an application. The current situation is full of hypocrisy anyway, because the involvement of the prosecutor in medical abortion, which is absolutely dominant at present, is neither appropriate, nor effective, nor at all possible. Times change. When Prof. Andrzej Zoll ruled that there was no widespread medical abortion, and today this method dominates. In such a case, the crime of abortion up to the twelfth week would be prosecuted only at the request of the woman. And there would be such cases, for example in a situation of blackmail or threats by people from the woman’s immediate environment. But the decision to prosecute would be left in the hands of women. Without this request, the public prosecutor’s office could do nothing
