The Sejm voted to lift the immunity of the President of the Supreme Audit Chamber, Marian Banaś. The Chief Inspector of Road Transport requested permission to hold the Head of the Supreme Audit Chamber criminally liable, and the case concerned exceeding the speed limit in built-up areas.
256 MPs voted in favor of the motion to agree to hold Banaś criminally liable in this case, 165 were against and 13 abstained.
The application was submitted in May 2022 by the Chief Inspector of Road Transport due to the fact that Banaś was driving a car and exceeded the speed limit in built-up areas of Warsaw by 15 km/h.
He broke the law
Two weeks ago, the Chairman of the Supreme Audit Office stressed at a meeting of the Parliamentary Rules Committee that “the case is indisputable” and that he wanted to pay the fine for the traffic violation from the beginning. However, the regulations do not allow for a fine to be imposed on the Chairman of the Supreme Audit Office, even if he wants to pay the fine immediately, the Sejm must agree to waive his immunity.
According to the Constitution, the President of the Supreme Court of Audit cannot be held criminally liable or deprived of his liberty without the prior consent of the Sejm.
