The wPolityce.pl portal has accessed the correspondence of the Constitutional Tribunal with the Government Legislation Center. This shows that Donald Tusk’s officials are still delaying the publication of the Tribunal’s rulings in the Journal of Laws. This is an open provocation aimed at the status of the Constitutional Court, its judges and the President.

In a letter dated May 23, signed with the name Julia Przyłębska, the President of the Constitutional Court Joanna Knapińska, President of the Government Legislation Center, recalls the Tribunal’s ruling of May 8 this year, which was not published in the Journal or Laws of the Republic of Poland. This is a statement that has nothing to do with politics. It concerned the failure to appeal against the decision to refuse an exemption from legal costs. The verdict was delivered to the Government Legislation Center on May 9 and is not even on the ‘List of laws waiting to be announced’ tab.
I would like to remind you that (…) the rulings of the Constitutional Court must be immediately published in the official body in which the normative law was announced. (…)

The President of the Constitutional Court also gave a valuable lesson to the President of the RCL.
Pursuant to art. 7 of the Constitution, state authorities operate on the basis and within the limits of the law, and the President of the RCL is also such an authority. The legal provisions do not grant the President of the RCL the power to take decisions modifying the order of the President of the Constitutional Court to immediately publish the judgment in the Journal of Laws.

No other entity, and certainly no executive authority, has such powers. The legal status thus designed is the implementation of art. 10 of the Constitution, which establishes the tripartite division and balance of power, one of the basic political principles of the Republic of Poland. It excludes the executive from controlling the judiciary, and this is how your delay in announcing the Constitutional Court’s ruling should be assessed. The current situation means that you, as chairman of RCL, are in a hurry.

It is extremely shocking that the President of the Constitutional Court is forced to teach an official of Donald Tusk who is not fulfilling her legal duties. This discredits Donald Tusk and his officials. It is also an expression of contempt for the law, the separation of powers and the independence of the Constitutional Court.
