“The migration pact is harmful, but also contrary to the principle of voluntariness adopted in 2018; it therefore constitutes a violation of EU law,” PiS MPs said during today’s press conference. According to Paweł Jabłoński, the pact should be appealed to the CJEU. “We expect the Tusk government to take up this issue,” he added.
The finance ministers of the EU countries finally approved the migration pact today. Three countries voted against: Poland, Slovakia and Hungary. The pact aims to comprehensively regulate migration issues in the European Union, including aid to countries under migration pressure.
“The Trojan Horse of Europe
This issue was discussed at a press conference in the Sejm by PiS politicians, including the club’s leader and former head of the Ministry of National Defense, Mariusz Błaszczak, and former deputy head of the Ministry of Foreign Affairs, Paweł Jabłoński. Błaszczak said the migration pact is a harmful solution, “a Trojan horse introduced in Europe”.

He judged that the approval of the migration pact would mainly affect Poland.

He stated that “it could be stopped if the architecture of the European Parliament changes after the June 9 elections.” However, Jabłoński stated that the pact itself was already contrary to EU law. The politician recalled the conclusions of the European Council summit of October 2018, which stated that all decisions regarding people who have entered the EU in an uncontrolled manner should take into account the principle of voluntariness.
The solutions adopted today by the EU Council are inconsistent with these principles, inconsistent with the principle of voluntariness, and this means a violation of EU law.

Appeal
According to him, this forms a basis for challenging the migration pact before the Court of Justice of the European Union.

New law
The migration package approved today in Brussels contains ten pieces of legislation. It sets out rules for dealing with people who try to enter the EU without permission, from how they are checked to determine whether they qualify for protection, to deportation if they are not allowed to stay.
The new regulations also aim to distribute responsibility for managing migration in the EU among all Member States. This must be achieved through the mandatory solidarity mechanism, which assumes the deployment of at least 30,000 people per year. people. The intention is to involve other Member States in providing support to countries under migratory pressure. Alternatively, EU countries can pay 20,000 PLN. euros for each person who is not admitted to or participates in operations at the EU’s external borders.
The European Commission will decide on the extent to which countries are involved in the solidarity mechanism, taking into account, among other things, the number of inhabitants and GDP of the Member States. Countries will also be able to apply to the EC for exemption from participation in the mechanism, citing migration pressure in their own country as the reason. Home Affairs Commissioner Ylva Johansson emphasized in previous statements that since Poland would accept Ukrainians, she would be partially or completely exempt from participating.
The approval of the pact means that the European Union has succeeded in reforming its migration policy and asylum system for the first time in twenty years. The reform became necessary in 2015, when almost a million people crossed the EU’s borders illegally. Then it turned out that the principle that these people should be the responsibility of the first EU country whose borders the migrants crossed meant too much pressure, especially for the southern European countries: Greece, Italy and Malta. Spain has recently recorded a sharp increase in arrivals to the Canary Islands.
