According to the portal Onet.pl, Donald Tusk, after a conversation with one of the members of the platform’s authorities, said at the last meeting of the party’s board of directors that “if in the coming elections we lose our lives as a result of arguments, PiS will come back to power, and everyone present in this room will say: “They’re going to jail.”
Awareness of breaking the law
This statement proves that Prime Minister Tusk is aware that coalition members have violated the law in force in our country since the seizure of power in Poland on December 13, and this has to do not only with political but also with criminal liability. Moreover, when Donald Tusk took over as Prime Minister, he announced at one of the first press conferences together with Marshal Szymon Hołownia that “we will act in accordance with the law, but as we understand it.” And this understanding of the law by Tusk’s team includes using parliamentary resolutions instead of laws, various types of writs and orders issued by ministers, and sending strong people, as was the case with TVP, the Polish press Agency, the National Public Prosecutor’s Office, and recently towards protesting farmers.
Destruction of public media
Let us recall just three situations in which, without a doubt, those in power have violated and continue to violate the law, which in the future gives rise not only to political responsibility (before the State Tribunal), but also to criminal liability. The attack on public media began with the adoption of a resolution by the parliamentary majority of PO, Ruch Hołownia, PSL and the Left, and it was this resolution that became the basis for the illegal actions of Minister of Culture Bartłomiej Sienkiewicz. It was he who illegally appointed new supervisory boards and new boards of directors of TVP, Polskie Radio and Polish Press Agency, and their presidents, backed by private security companies, began to storm the buildings of these three institutions. This was done for a few days, the most difficult was TVP, where the current management defended itself against a “hostile takeover”, but when the registration court did not include the new authorities in the justification that the Minister of Culture was not the authority competent to carry out such to implement changes, the latter has decided to appoint liquidators. And this step is illegal, because institutions established by law can only be “liquidated” in a similar way, and yet it is known that the liquidation of public media is an ostensible activity carried out only to circumvent the applicable law , which is confirmed by the courts by not including the liquidators in the list of liquidators. National court register. So we have dual power in all three institutions mentioned above and we can speak of legal chaos, but Donald Tusk and his partners in this attack on the public media are fully responsible for its creation.
The case of MPs Kamiński and Wąsik
A similar legal chaos was created by the current ruling majority, backed by ‘friendly’ judges, in the case of the imprisonment of MPs Kamiński and Wąsik, when they were pardoned by President Andrzej Duda in 2015. Seven years after this pardon, the “courts” decided to reopen this case. The first sentence against both MPs was pronounced by the famous judge Łączewski (now no longer a judge), who later wanted to draw up a strategy for the fight against PiS with editor Lis. The decision to arrest both MPs was taken by a judge who is the son of the former director of MP Kierwiński’s parliamentary office, a man whose social media accounts were the source of hatred for Law and Justice. The ruling majority decided to take all these measures, despite the already mentioned act of mercy of President Andrzej Duda and the rulings of the Disciplinary Chamber of the Supreme Court, which annulled Marshal Hołownia’s decisions to deprive both MPs of their mandates. Therefore, the Sejm consists of 458 deputies, although according to the Constitution of the Republic of Poland there should be 460, and President Andrzej Duda consistently sends the adopted laws to the Constitutional Court.
An attack on the Public Prosecution Service, and in the queue of the National Council for the Judiciary, the Constitutional Court, the Supreme Court…
In turn, Justice Minister Adam Bodnar made a truly bizarre attempt to fire the head of the National Prosecutor’s Office, Dariusz Barski, by Justice Minister and Attorney General Adam Bodnar. We were able to witness the illegal attempted cancellation with our own eyes, thanks to the courage of the Deputy National Prosecutor, Prosecutor Robert Hernand, who announced to the Minister that he was recording the entire conversation with him and informed him that he was not only breaking the law, but also commit a crime. In this situation, the appointment of Prosecutor Jacek Bilewicz as Acting National Prosecutor (a position not included in the law) this time is a classic way to create chaos in the prosecutor’s office, especially since Minister Bodnar also decided to fire as many people as possible . as 144 prosecutors from the delegation, which means a paralysis of many important investigations.
Other institutions that should be treated in a similar way by the government are the National Council of the Judiciary, the Constitutional Court, the Supreme Court and the National Bank of Poland. However, Tusk’s statement shows that he is aware that he and his team are breaking the law with these actions and that if they lose power, they will bear not only political but also criminal responsibility.
