“Is there even one sentence in your report about the unconstitutional decisions of Donald Tusk’s government?” – Dominik Tarczyński, MEP for Law and Justice, asked EU Justice Commissioner Didier Reynders. The European Commission recently published its Rule of Law 2023 report.
In Strasbourg, a debate on the Commission’s report on the rule of law in 2023 took place during the plenary session of the European Parliament. Polish MEPs Dominik Tarczyński and Patryk Jaki from the European Conservatives and Reformists group took part in the conversation with Commissioner Reynders.
In the report I try to find at least one sentence about Tusk’s government and its unconstitutional decisions. Does your report contain at least one sentence about unconstitutional decisions of the Polish government?

The MEP pointed out that the left was using the report as a political tool against conservative governments.

He emphasized that there is currently no unconstitutional action by the current Polish government.

Patryk Jaki pointed out that this is yet another report on violations of the rule of law.

Attack on the public media
The politician of Sovereign Poland recalled the case of public media in Poland. As he noted, although their authorities had a term of office by law, “Tusk would not wait and took them away by force.” The MEP noted that Tusk’s government did this without any legal basis “and fired almost all employees, including a pregnant woman and disabled people, and ordered the buildings to be surrounded by police.”
Jaki also emphasized that the Minister of Culture, Bartłomiej Sienkiewicz, used false notarial documents to carry out this “action”, after which the prosecutor who discovered it was demoted.
Attack on the judiciary
Meanwhile, the illegality of these actions has been confirmed by the courts and the Constitutional Court
– he pointed out.
The ECR member added that Tusk and his team have not complied with any judgment on the matter. He also quoted the words of Minister Sienkiewicz, who considered the Constitutional Court’s decision as “non-existent” because it “does not meet the criteria of significance”.
Real lawyers and people who shouted about the independence of the courts must be quite upset to hear that the minister’s announcement about the ‘interest’ trumps laws and the constitution.

He also referred to the illegal actions of Justice Minister Adam Bodnar in dismissing judges from their positions. The MEP asked the Commissioner whether the EU wanted such “independence”.
He also pointed out that “the people of Tusk took on the role of the national prosecutor.”
Unable to dismiss him without the president’s consent, they took over his office by force, disabled his and his deputies’ cards, and did not allow them to enter the building.
