The Ordo Iuris Institute warns that the European Union is continuing the procedure of amending EU treaties, and Donald Tusk’s government supports this, “relieving the vigilance of Poles.” Therefore, ten areas – including education, defense and industry – are at risk of losing national sovereignty. A report has been drawn up on this subject “Why do we need sovereignty?”, which must be sent to the European MEPs to stop the changes.
The European Parliament recently adopted amendments to the EU Treaties, which assume that the Community will take over the powers of the Member States in ten areas. As indicated by the Ordo Iuris Institute, this concerns foreign policy, borders, currency, industry, cross-border infrastructure, climate policy, health care, defense, education and family matters.
Tusk’s government ‘relaxes Poland’s vigilance’
The Prime Minister of the Polish Government assured that changes that violate the sovereignty of our country are not possible. However, as usual, the guarantees are not consistent with the actions.
Donald Tusk played the role of a good police officer. In his parliamentary statement, he assured that “no attempt to change the treaties of the European Union against the interests of Poland is excluded.” He boldly announced that Poland would decide the direction of change in the European Union during his rule
– wrote the president of the institute, Jerzy Kwaśniewski, in a statement.
The procedure for amending the EU treaties has progressed like clockwork. Since December 13, Poland has quietly supported the changes, calming Poles’ vigilance. Ordo Iuris is currently the main voice of opposition in Poland
– he pointed out.
Kwaśniewski pointed out that “the EU wants to take away our army; that he wants to control Polish industry and, without Warsaw’s participation, decide on the development of major projects such as CPK or seaports.
As he also noted, “the representative of the Tusk government could have opposed further discussions of the draft amendments to the EU treaties at the EU Council meeting… but she did not do so.”
Changing EU treaties
As he noted, the amendment of the treaties also concerns the abolition of the veto in matters related to foreign policy. The lawyer explained that “it means the possibility of starting a customs war with the US or entering into an energy alliance with Russia – against the interests of Poland and even despite the opposition of several EU countries.
This transfers a large area of independence into the hands of Brussels and Berlin
– he assessed.
The lawyer added that “only universal opposition can stop the fast-paced German machine to take over Europe.”
10 areas at risk of losing their sovereignty
Ordo Iuris recently presented a report “Why do we need sovereignty?”, in which it pointed out that “the treaty changes are intended to permanently deprive Poland of sovereignty in ten specific areas – essential for our national sovereignty.”
The Institute warned that defense is one of the risk areas.
Implementation of the reform could lead to the EU taking control of the Polish armed forces, closing Polish embassies and replacing Polish diplomats with EU services.
– stated in the announcement.
Kwaśniewski emphasized that “it is also the final control over the flow of immigrants to Brussels. The European Union will be able to take control of important branches of Polish industry, close mines and ports and acquire exclusive authority to conclude climate protection agreements.
The Ordo Iuris report will be sent to MEPs from several member states to help block the changes.
In the report we set out ten specific areas of the proposed transfer of national sovereignty. Experts gathered by the Ordo Iuris Institute wrote about the loss of self-determination in the areas of: climate protection, health policy, cross-border infrastructure, border protection, foreign policy, security and defense, industry, education, monetary policy and family law. We have dedicated a separate chapter of the report to each of these issues, discussing the scope of the transferred national powers and their expected consequences.
– said the president of the institute.
Centralization and the superstate
He pointed out that “from the whole package of changes emerges a specific vision of a ‘European superstate’, economically centralized and managed from above at a level that significantly exceeds US federalization.”
Experts warned that the EU would have “exclusive competence to conclude international agreements on climate change and remove the ‘environment’ area from the scope of shared competences, which will result in the EU taking exclusive competence over natural environmental issues. ” One of the direct consequences is also that it is “a blow to the constitutional principle of energy security”.
As noted, “different – often conflicting – interests exist in individual Member States regarding the future of energy.”
The clearest example of this is Germany’s energy policy, which for decades assumed close cooperation with Russia, which is contrary to Polish interests.
– marked.
Infrastructure and investments
Kwaśniewski also pointed out that one of the amendments to the treaties “presupposes the extension of shared competences – within which the Union has priority over the Member States – in the field of transport, so as to include cross-border infrastructure.” He added that “this will apply to all modes of transport: road, rail, sea, air and inland waterways.”
The institute’s president explained that this could mean that European countries “will be denied the opportunity to make sovereign decisions on, among others, roads of international importance, interstate railway links, international airports and seaports.”
In the Polish context, the amendment would affect sovereign powers in the planning and implementation of investments such as: the Central Communications Port, the development of the Port of Gdańsk, the construction and development of an LNG terminal (gas port) or the planning and development of the port. construction of Via Carpatia
– he emphasized.
Currency and defense
The lawyer also noted that “the draft treaty amendments adopted by the European Parliament also provide for the inclusion of a simple sentence in the treaty that ‘the currency of the Union is the euro’.”
Ordo Iuris warned that the transfer of powers to the EU common policy would also apply to defense and security issues, and as a result would deprive nation states of their own defense capabilities and make them completely dependent on decisions taken in Brussels taken.
Education and healthcare
The lawyer pointed out that the EU also plans to take decisions on matters related to the upbringing and education of children.
The amendments also include EU officials making decisions on sex education, the availability of abortion, surrogacy, gay adoption, and the possibility of imposing a common, European reading list and uniform history education on Polish children from above.
– he pointed out.
As Kwaśniewski noted, “the key powers of the Minister of Education could be taken over by an EU Commissioner, which, however, cannot be changed during the next national parliamentary elections.”
The Institute warned that health is also one of the areas at risk.
If a new epidemic is declared, this could lead to central sanitary policies, including decisions to restrict rights and freedoms (including through the introduction of lockdowns, movement restrictions and mandatory vaccinations), bypassing the Polish government and parliament.
– noticed.
Procedure for amending EU treaties
The procedure for amending the treaty started in 2023, when the project was adopted at the European Parliament forum. The procedure then went to the Council of the European Union (made up of the relevant ministers of the individual member states), which in turn forwarded it to the next stage of the procedure on December 18.
In the third phase of the procedure, the European Council (composed of Heads of State and Government) will decide by simple majority to convene a convention composed of representatives of national parliaments, Heads of State and Government, the European Parliament and the European Union. Commission
– the lawyer noted, explaining that “the convention will make a preliminary substantive assessment of the amendments tabled by the European Parliament and then adopt – by consensus – recommendations for the Intergovernmental Conference.”
Alternatively, the European Council itself could make such a recommendation without convening a convention, but such a step would require the approval of the European Parliament.
– added.
The most important stage of the procedure will be the convening of an intergovernmental conference by the President of the EU Council.
It is then that representatives of the member states’ governments will develop the final content of the treaty changes, which can only be adopted by consensus. After that, you will no longer be able to make any changes to the content of the changes
– noted the lawyer.
The final stage of the procedure is the ratification of the new treaties by all Member States in accordance with their constitutional requirements. As the lawyer explained, “in the case of Poland, the ratification of treaties is the responsibility of the President of the Republic of Poland, who must obtain the prior consent of Parliament.” It also explains that “as the proposed changes would significantly expand the EU’s powers, such consent would have to be expressed separately by the Sejm and the Senate – in each case by a two-thirds majority vote.” He added that “agreement for such ratification could also be expressed through a referendum.”
