First a mysterious visit by prominent members of the highly politicized association of judges ‘Iustitia’ to the Ministry of Justice, and then a shocking announcement from Adam Bodnar, questioning the status of judges and the rulings of the Constitutional Court. According to information from the wPolityce.pl portal, the judicial ‘caste’ demands extreme actions from the new Minister of Justice, even actions that openly violate the Constitution. Did the judges come to demand payment for supporting Tusk’s party in the election campaign?

The recordings of smug judges from ‘Iustitia’ were sent to us by a group of concerned Ministry of Justice employees who asked to remain anonymous. They show the TVN television crew and, among others, Judge Krystian Markiewicz, chairman of “Iustitia”, Judge Waldemar Żurek of “Themis”, Maciej Ferek, Paweł Juszczyszyn, Piotr Gąciarek and other judicial activists who have been most involved in the political activities of the past eight years. Our information indicates that some cases of Krakow judges who took part in the meeting with Bodnar may have been removed from the docket. All this so that they could peacefully meet the Minister of Justice. Interestingly, a number of them are subject to disciplinary proceedings initiated by Judges Schab, Radzik and others.
After all, the minister cannot meet them openly, especially since he can appoint his own ‘ad hoc’ spokespersons who can take over the cases of members of the judicial ‘caste’ in order to dismiss or manipulate them.

The meeting must have been very productive, and that was probably the point, as the politicized judges expressed their dissatisfaction with Adam Bodnar’s supposedly ‘too few’ radical actions. The rumblings of discontent must have been heard by the Minister of Justice. Yesterday’s meeting with the judges of “Iustitia” quickly produced results. Today, Adam Bodnar released another statement openly attacking the rule of law and the Constitution. This time, Adam Bodnar and his applicants targeted the National Council for the Judiciary.
Due to the fact that the Act of 8 December 2017 amending the Act on the National Council for the Judiciary (KRS) and certain other laws (Official Gazette of 2018, point 3) led to a conflict with the Constitution of the Republic of Poland and European standards, politicization of the procedure for selecting judges-members of the National Council of the Judiciary, this body, which is crucial for maintaining the independence of the Polish judiciary, has lost its guarantee of independence from the legislature and executive authorities lost. As a result, the status of judges appointed with the cooperation of this body has become defective, which is confirmed by a number of judgments of both international tribunals and Polish courts.

And perhaps make it easier for these parties permanent and “apolitical” communication and organizing an “Iustitia” office in the Ministry of Justice building?
