The Lublin-Wschód District Court in Lublin, located in Świdnik, 6th Commercial Division of the National Court Register, has rejected Lieutenant Colonel Sienkiewicz’s request to put Radio Lublin into liquidation! The court’s referee referred to the ruling of the Constitutional Court of January 18.
Liquidation of regional PR stations
Let us not forget that on December 29, 2023, Sienkiewicz announced the liquidation of the radio stations included in Auditorium 17 – a radio agreement concluded in 2001 that coordinates the activities of local Polish radio stations. It is a company whose shareholders are 17 Polish regional radio stations. As part of the agreement, these radio stations will exchange programs, reports and materials. Auditorium 17 includes: Radio Białystok, Radio Pomorza and Kujawy (Bydgoszcz), Radio Gdańsk, Radio Katowice, Radio Kielce, Radio Koszalin, Radio Kraków, Radio Lublin, Radio Łódź, Radio Olsztyn, Radio Opole, Radio Poznań, Radio Rzeszów, Radio Szczecin , Radio dla Nasze (Warsaw), Radio Wrocław, Radio Zachód (Zielona Góra).
According to Sienkiewicz, the liquidation was the result of an earlier decision to liquidate the public media – the Polish Press Agency, Polish Radio and Polish Television.
On January 22, the Warsaw court rejected the request for registration of TVP’s curator in the register of the National Court. This means that Bartłomiej Sienkiewicz’s entire operation, which involved illegally taking over the company through the liquidator method, failed. On the same day, a similar decision was also issued regarding the curator of Polskie Radio. Interestingly, the referee referred to the judgment of the Constitutional Court, which ruled Sienkiewicz’s actions unconstitutional.
The application regarding Radio Lublin was rejected
On January 1, the court in Świdnik rejected the Minister of Culture’s request to liquidate Radio Lublin. This is the first such case in the country. The opening of the liquidation took place, among others, in the case of Radio Olsztyn, Radio Kielce and “Radio dla Nasze” – in this case the decision was appealed.
What is important, In his reasons, Registrar Kamil Żurek referred to the judgment of the Constitutional Court, which ruled that in the case of public television and radio, the provisions on the possibility of liquidation were unconstitutional.
