Proc. Jacek Bilewicz, who took over the non-existent position of acting PK by decision of Minister Bodnar, explains his presence in the premises of the Public Prosecution Service. “I have the right to work there not only as an acting national prosecutor, but also as a prosecutor of the national prosecutor’s office,” Bilewicz wrote on the platform.
The Minister of Justice, in violation of the law, attempted to dismiss National Prosecutor Dariusz Barski and appoint Jacek Bilewicz in his place. Unfortunately, he cannot do this without the consent of the President – this is stated in the Law on Public Prosecutions. For this reason, Bodnar is trying to introduce Bilewicz to the position of head of PK as acting head, but the law does not provide for such a position.
What does Bilewicz do at PK?
Adam Bodnar does not give up and tries to install Bilewicz at the National Public Prosecution Service, contrary to regulations, the comments of the Deputy Attorney General and even President Duda himself. He claims he won’t go back on his decision. He is echoed by his protégé, Prosecutor Bilewicz, who assured this on stage

Likewise, Minister Adam Bodnar, who is also Attorney General and has his office in Postępu, has unrestricted access to the headquarters of the National Prosecutor’s Office.

Bilewicz claims he makes decisions as PK and no one questions them. Michał Ostrowski, Deputy Attorney General, has a different opinion and said in an interview with the wPolityce portal:
Mr Bilewicz is a prosecutor at the National Public Prosecutor’s Office and does not hold any position there. We expect him to report to work and be assigned duties typical of any PK prosecutor;

Barski, hereinafter referred to as the National Prosecutor
The legal situation of National Prosecutor Dariusz Barski is clear. It was defined yesterday by President Andrzej Duda, stating that he is still the national prosecutor. The PG delegates who took part in the meeting with the president have the same opinion.
No one has effectively dismissed me from the position of National Prosecutor. President Duda informed me that he did not agree to the dismissal and emphasized that, in accordance with applicable regulations, I am a national prosecutor

Minister Adam Bodnar, who is also Attorney General, is illegally trying to change the leadership of the National Prosecutor’s Office, which is a separate structure from the Ministry of Justice and governed by its own regulations. Although the PK is overseen by the Minister of Justice, changes in its leadership are entirely dependent on the president’s approval. Adam Bodnar did not obtain this permission or even ask for it. For this reason, as President Duda stated, Prosecutor Dariusz Barski is still the PK, and not Prosecutor Jacek Bilewicz.
