Marcin Matczak – a lawyer not known for his sympathies with Law and Justice – had to deal with ‘smiles’ sent to him by supporters of the coalition led by Tusk. The reason was his call on Adam Bodnar to respond to the President’s request to suspend the execution of the sentence for MPs Wąsik and Kamiński. Roman Giertych also contributed by eventually… blocking the lawyer on Twitter/X.
Pardon procedure
Let us not forget that on January 11, President Andrzej Duda announced that he had initiated pardon proceedings against Mariusz Kamiński and Maciej Wąsik at the request of their wives. President Duda emphasized that the proceedings would be conducted in “presidential mode.” He also requested that Attorney General Adam Bodnar suspend the execution of the sentence and release the prisoners for the duration of the pardon proceedings.
Mariusz Kamiński and Maciej Wąsik, members of parliament, stage a hunger protest. As Jarosław Sellin revealed on television wPolsce.pl, during an intervention at the Radom Remand Center with MP Jerzy Połaczek, they were told that Mariusz Kamiński was in good mental condition, but the physical consequences of his hunger protest were already visible.

Matczak vs. Giertych
The president’s actions were supported by… Marcin Matczak. The lawyer, who was by no means sympathetic to PiS, appealed to Adam Bodnar in a post on social media and on TVN24 to release MPs Mariusz Kamiński and Maciej Wąsik from serving their sentences.
I make a very serious appeal to Minister Bodnar to respond to President Duda’s request to suspend the execution of the sentences for Mr Wąsik and Mr Kamiński and to release the convicts for the duration of the pardon proceedings. We need to lower the emotions – PAD has taken the right step in this direction, which deserves a similar response
– Matczak emphasized in a message on Twitter.
Matczak’s position deeply outraged another lawyer, Roman Giertych, who was known for his handling of Tusk’s family cases. The new addition to the Civic Coalition ranks paid close attention to Matczak. First, he stated that his client had been litigating for sixteen years to get Kamiński and Wąsik sent to prison.
And she has paid a terrible price for it over the past eight years. How would you like to restore her rights and emotions? Shouldn’t the law be on the side of the citizens, and not on the side of the politicians?
– Giertych asked Matczak.
Matczak responded that Giertych’s client “tried to have Wąsik and Kamiński convicted – this happened.”
Their guilt is confirmed – this is compensation. Neither they, nor I, nor you have any influence over how the President administers the law of pardons, and it is as a result of his actions that they will not be imprisoned. And art. 568, which allows their release during pardon procedures, is in force. This must take into account the general interest, ie the interest of the citizens, and not just the interest of your client.

However, this was not enough for Giertych, who stated in the next contribution that “it is in the deepest public interest that citizens know that we are equal before the law.”
Pardoning criminals because they are the president’s friends is so clearly contrary to this interest that I wonder how any lawyer can express such opinions without shame.

Mr. Lawyer, the view that the President can pardon anyone he pleases is expressed in our Constitution in Art. 139. Please write to the Constitution, and not to me, that there is no shame
– replied Matczak.
Giertych must have felt insulted because he replied to Matczak that his submission “did not refer to the powers of the president, but to the social interest you referred to.”
If you intend to conduct a discourse based on publishing ‘my’ opinions of your own making and then courageously combating them, then further exchange of opinions is pointless.

In the next post, Giertych stated that he was blocking Matczak and called on internet users to do the same.
