It seems to me that what we are observing is simply an expression of anarchy in the country, Krzysztof Bosak, Vice-President of the Sejm (Confederation) said on Polskie Radio 24 on Thursday, when asked about the case of Mariusz Kamiński and Maciej Wąsik.
On Tuesday, police arrested PiS politicians, former heads of the CBA, Mariusz Kamiński and Maciej Wąsik, who were staying in the presidential palace at the time. The politicians were convicted on December 20 last year. a final sentence of two years in prison in connection with the so-called land scandal.
When Krzysztof Bosak was asked whether Mariusz Kamiński and Maciej Wąsik should remain in custody, he emphasized that “such matters should not be decided by politicians, but by the court, which should be guided by the law.”
Asked whether the pardon of both politicians by President Andrzej Duda was ineffective, the deputy marshal emphasized that “in a constitutional state, the law, the decisions of the relevant state bodies and the relevant authorities should decide.”
I have been closely monitoring this situation for many days, I have the opinions of various so-called authorities and texts of the Polish Constitution, laws and applicable rulings. It seems to me that there are no grounds under the legislation in force in Poland to claim that the President’s pardon is not valid. On the contrary, we have three rulings of the Constitutional Court that confirm the president’s powers in this area
– said Bosak.
Anarchy in the state
It seems to me that what we are witnessing is simply an expression of the anarchy in the country. Some state authorities and judges respect the powers, constitutional prerogatives of the President and the rulings of the Constitutional Court and the rulings of one of the chambers of the Supreme Court, while the other part of the judges and the current state authorities, the government currently governing the police and control the prison system, do not respect the prerogatives of the President, the rulings of the Constitutional Court and the rulings of part of the Supreme Court
– emphasized the Deputy Chairman of the Sejm.
The former head of the CBA and former Minister of the Interior, Mariusz Kamiński, and his former deputy, Maciej Wąsik, were convicted on December 20 last year. a final sentence of two years in prison in connection with the so-called land scandal.
The case was brought up again after more than eight years in connection with the Supreme Court’s ruling in June. In early June last year, the Supreme Court of the Criminal Chamber, after cassation appeals filed by assistant prosecutors, annulled the termination of the case of the former heads of the CBA, filed in March 2016 by the District Court in Warsaw in connection with the pardon law introduced by President Andrzej was used. Duda against the then wrongfully convicted former heads of the CBA and referred the case to the Supreme Court for reconsideration.
On Monday, President Duda met with the Chairman of the Sejm, Szymon Hołownia, about politicians. After the meeting, the president said that he had proposed to Hołownia that, in order to close the Kamiński and Wąsik case, he should recognize the 2015 pardon as effective. The president added that he and the marshal had not reached an agreement on this.
On Tuesday, Kamiński and Wąsik took part in the ceremony of the appointment of presidential advisors at the Presidential Palace; later they stayed there. In the evening they were detained by police in the presidential palace.
