Former CBA head and former Interior Minister Mariusz Kamiński and his former deputy Maciej Wąsik – elected as MPs from PiS lists in October elections – were convicted on December 20 last year. a final sentence of two years in prison in connection with the so-called land scandal. The Marshal of the Sejm, Szymon Hołownia, issued decisions on the expiry of the parliamentary mandates of Kamiński and Wąsik. The problem is that both the judgment of the Court of Appeal in Warsaw and Hołownia’s decision to waive the fines were unlawful. MPs Wąsik and Kamiński were pardoned by President Andrzej Duda in 2015.
On Wednesday, the Chamber of Labor and Social Security of the Supreme Court received appeals from Maciej Wąsik and Mariusz Kamiński, filed by the Marshal of Hołownia, against the Marshal’s decision to terminate their mandate. The settlement between Hołownia and President Piotr Prusinowski caused a wave of negative comments and, in the case of Maciej Wąsik, ended with the embarrassment of the Sejm chairman. On Thursday morning, the Labor Chamber of the Supreme Court decided with regard to Wąsik’s dismissal to transfer the case to the Chamber for Extraordinary Control and Public Affairs of the Supreme Court. It was then reported early on Thursday afternoon that the Supreme Court’s Extraordinary Control Chamber had revoked the Sejm Speaker’s decision to terminate the mandate of MP Maciej Wąsik. On Friday it was reported that the same chamber had revoked the decision of the Speaker of the Sejm regarding the expiry of the mandate of MP Mariusz Kamiński.
In a message published on the X website (Twitter) on Monday, Wąsik referred to Marshal Hołownia’s letter addressed to him on December 21. “I received the notice on Friday and today I received a letter from the Marshal of Hołownia, dated December 21. In it, he requests that he relinquish his parliamentary duties until the appeal to the Supreme Court is resolved. The Supreme Court decided on January 4 in my favor. So back to my duties! January 10 in the Sejm! – wrote the PiS politician and posted a photo of a letter dated December 21 last year, addressed to Wąsik by the chairman of the Sejm.
In the document attached to the letter, the Marshal of the Sejm informs that Wąsik has received the decision to terminate the mandate of a deputy, and also calls on him “to refrain from exercising the rights and obligations arise from the exercise of the parliamentary mandate. , in particular to abstain from voting at the meetings of the Sejm and its bodies” until provided for in the Electoral Law, and in case of appeal to the Supreme Court – until the matter is resolved by the Supreme Court.
