Mariusz Kamiński and Maciej Wąsik are not going to jail. The court accepted PiS MPs’ requests to postpone the execution of prison sentences.
Judge Aleksandra Smyk informed Onet.pl about the decision of the District Court for Warsaw-Śródmieście.
Due to the requests filed, no order has been issued to date for the execution of the judgment against the two persons convicted in the above-mentioned case
– said Judge Smyk.
Persons against whom the execution of the sentence was ordered and orders issued to take them to penitentiary units filed requests for postponement of the execution of legally imposed prison sentences (Article 151 of the Criminal Code), together with requests for suspension of the enforcement of judgments in this regard (Article 9§4 of the Criminal Code).
– the Warsaw court responded to the portal.

Requests to suspend the execution of a judgment
Judge Smyk announced that the applications had been assessed positively.
Due to the need to immediately process requests for suspension of the execution of the sentence (Article 9§5 of the Criminal Code) and due to the absence of the Registrar, these were assigned for processing via the Random Case Assignment System to a other executive judge. The court’s decision granted the requests, resulting in the revocation of the detention documentation and the repossession order
– argues the chairman of the court.
