War, among other things, German environmental organizations regarding mining concessions in the Turów mine have been in court almost since the beginning of this year. In June, the Provincial Administrative Court in Warsaw refused to allow ecologists to suspend the Ministry of Climate’s decision on the mining permit, which became a pretext to attack our country’s energy security. The wPolityce.pl portal noted that the Supreme Administrative Court rejected the complaints of environmental organizations against the decisions of the Provincial Administrative Court of June this year. It is also a success of the National Public Prosecution Service, which submitted its position on this issue to the Provincial Administrative Court and took part in the legal battle in favor of the Polish mine.

The case concerns complaints from April and May 2023, which were submitted by associations and individuals to the Provincial Administrative Court in Warsaw in connection with the decision of the Minister of Climate and Environment of February 17, 2023 on the amendment of the permit for the extraction of lignite and related minerals from the lignite deposit “Turów”. The contested decision sets the term for the implementation of the concession until April 27, 2044. In these complaints, the parties requested suspension of the implementation of the contested decision.
The Provincial Administrative Court in Warsaw, in its decision dated June 22, 2023, refused to suspend the implementation of the contested decision. In the reasons for the decision, he indicated that the contested decision changed the deadline for granting the concession to April 30, 2026, as laid down in the concession of April 27, 1994 No. 65/94 (as amended), and that this set on April 27. , 2044.

However, environmentalists did not give up and filed complaints. These were resolved by the Supreme Court of Administrative Affairs in November this year and were dismissed.
