PiS MP Krzysztof Szczucki, who represents the applicants before the Constitutional Court, pointed out at a press conference that TVP, Polskie Radio and regional radio stations are joint-stock companies established under the Broadcasting Act.
The rules of the Companies Code should apply to them, but only to the extent that other specific provisions or principles are not provided for in the Broadcasting Act.

We are appealing to the Constitutional Court against this provision, which refers to the Companies Code, because it is inaccurate and contrary to the Constitution in this respect. He added that if (Prime Minister) Donald Tusk, the head of the Ministry of Culture (Bartłomiej Sienkiewicz) or other members of the coalition decided to interfere with the public media, “the restoration of the legal state after the judgment of the Constitutional Court may no longer be possible.”
Therefore, the Constitutional Court had every right to issue a freezing order

Any interference by the Minister of Culture in the management of public television or Polish radio, any attempt to liquidate these media, or other actions that could be aimed at preventing these media from continuing their mission will be illegal. They constitute a constitutional tort, a criminal tort, and will and should entail criminal liability

The request to the Constitutional Court was submitted by a group of PiS MPs and concerns the assessment of the constitutionality of the Broadcasting Act in the scope in which it refers to the Commercial Code, and in particular to the provisions of this Code regarding the liquidation and dissolution of capital companies and the dismissal and suspension of directors by the general meeting.
