“A draft law on professional artists, directed by Prime Minister Mateusz Morawiecki, was submitted to the Sejm. The Minister of Culture and National Heritage had the authority to express the government’s position on this issue during parliamentary proceedings,” the Prime Minister said.
The project, prepared by the Ministry of Culture and National Heritage, emphasizes that “the idea is to include artists in the general pension, disability and health insurance system while providing them with a support mechanism in paying contributions.”

Artist permissions
The bill provides, among other things, for the establishment of the Polish Chamber of Artists, which is responsible, in particular, for assessing matters related to confirming or updating the qualifications of a professional artist, granting subsidies to professional artists for social security and health insurance contributions and social support. The chamber council will consist of fourteen representatives from organizations representing artists, five from the minister responsible for culture and protection of national heritage, one from the minister responsible for social security and one from the Social Insurance Institution.
Procedures for obtaining, certifying and updating the qualifications of a professional artist based on achievements confirmed by organizations representing representative artistic communities, as well as income from artistic activities, are also regulated.
In addition, the rules for artists’ access to the social and health insurance system have been defined, adapted to the functioning of the insurance system. Any artist who does not have a title from another source, for example business activity or employment relationship, will pay contributions calculated on a basis not exceeding the minimum wage.
The state budget will finance subsidies for social insurance and health insurance for the lowest-earning people with artist status.
Professional artist
The bill assumes that professional artists pay pension, health, disability and health insurance premiums due to their current qualifications as a professional artist, whose average monthly income (from all sources, not just artistic activities) was less than 80 percent. average salary in the national economy in the previous calendar year, a subsidy will be provided upon request, which will range from 20%. up to 80 percent mandatory social security and health insurance contributions, calculated on the basis of their assessment, not exceeding the minimum wage.
A Professional Artist Card (similar to the Large Family Card) is being introduced, creating packages, amenities, discounts and offers for this social group.
The new regulations stipulate that every artistic activity has a creative character, regardless of whether the artist is entitled to property rights (“creators”) or related rights (“performers”) under copyright law. The result of this will be the introduction of 50 percent. costs of obtaining income from artistic activities for all professional artists.
