The main changes proposed include abandoning the principle of unanimity in EU Council voting in 65 areas and transferring powers from Member State level to EU level, including: through two new exclusive powers of the EU – in the areas of environmental protection and biodiversity – and by significantly expanding shared competences.
These steps being taken are completely contradictory to the idea of the EU, that is, a community of sovereign states, regardless of the size of these states. Each of these countries has its own legal system, and the society represents a certain value system, and they differ. Of course there is some reference to common European values, but each country has its own typical legal system
— Przyłębska said on TVP Info.
As she noted, “hitherto we have worked on the principle that each of these countries had an equal say, and now it appears that we are going to have the domination of Germany and France, the largest countries which have acquired such a position that they want decision-makers in matters that are completely outside their competence.
I think there is an issue at the moment related to public dissatisfaction when it comes to Germany’s functioning in the EU. German society believes that Germany is losing its membership of the EU (…) and there is a feeling that if Germany starts governing the EU, the current government may show that it has the problem under control got
– assessed the President of the Constitutional Court.
