The Council of Ministers expresses its strong opposition to the draft amendments to the EU treaties tabled by the European Parliament’s Committee on Constitutional Affairs; also obliges the Prime Minister and all ministers to oppose these proposals if they are adopted by the European Parliament, according to the resolution adopted by the government.
Treaty changes and the Polish government’s opposition
On Tuesday, the government adopted a resolution on the draft amendments to the treaties submitted to the European Parliament. In it, the Council of Ministers “expresses strong opposition to the draft amendments to the EU treaties submitted by the European Parliament’s Committee on Constitutional Affairs.”
By radically limiting the application of the principle of unanimity in the Council and, moreover, seeking to limit the powers of the Member States in strategic areas of the functioning of the state, this project fundamentally reduces the sovereignty of the Republic of Poland – to such a level . to the extent that if this project were to be adopted, this sovereignty would in practice become a total fiction

The resolution assessed that “the proposals contained therein have the effect of depriving the Republic of Poland of the opportunity to independently take important decisions in the areas of foreign policy, defence, border protection, security (including energy security), home affairs, justice and social policy. , economic policy, tax policy and other areas important from the point of view of state interests.
Adoption of these proposals would be contrary to the Constitution of the Republic of Poland, and in particular contrary to the principle of the supreme power of the nation, as expressed in Art. 4 of the Constitution of the Republic of Poland

Furthermore, it was noted, “adopting solutions that would remove the fundamental principle of unanimity in international law in future treaty amendments would be in direct conflict with Article 90 of the Constitution of the Republic of Poland and would allow Poland to be bound to an international agreement without its consent, thereby circumventing the constitutional requirements for ratification and without any consent from the constitutional bodies of the Republic of Poland.
It was indicated that the Council of Ministers emphasizes strong support for the presence of Poland in the European Union, which is an alliance of cooperating, equal, free and sovereign states.
By signing the Accession Treaty, the Republic of Poland has expressed its will to participate in this Alliance on the basis of such principles

At the same time, the Council of Ministers indicates that the currently proposed changes regarding the institutions of the European Union, the way they make decisions and the procedures for amending treaties, which limit the role of the Member States, combined with changes regarding to the powers Admittedly, aimed at the centralization of the European Union, contrary to the principles of the founding treaties, and contrary to the objectives for which most Member States joined the Union

It also included the assessment that “it is impossible not to note that the solutions proposed do not essentially serve to improve cooperation between all members of the European Union, but to pursue the interests of its two largest Member States, which , these changes will allow them to increase their dominance over EU processes.” Political and economic life in Europe.
Taking into account the obligation to guarantee sovereignty, which is the basis of its policy, the Council of Ministers asks the Members of the European Parliament to express their opposition to the changes to the treaties proposed by the Committee on Constitutional Affairs. The Council of Ministers also obliges the Prime Minister and all members of the Council of Ministers to oppose these proposals if adopted by the European Parliament and to submit them to the Council or the European Council.

Debate and draft resolution in the Sejm
On Monday, the Sejm received a draft resolution, submitted by the PiS club, on “stopping changes to the Treaty on European Union and the Treaty on the Functioning of the European Union that are dangerous for the Republic of Poland.” On Tuesday it was given a form number and the project was sent to the European Affairs Committee for first reading.
On Tuesday, the European Parliament held a debate on the report of the European Parliament’s Committee on Constitutional Affairs (AFCO), which recommends changes to the EU treaties. The main proposed change is the abolition of the unanimity rule for voting in the EU Council in 65 areas. The vote on whether to adopt the report will take place on Wednesday.
