The Sejm is against the proposals to amend the EU treaties presented in the EP committee report; their approval would violate the Constitution of the Republic of Poland and would deprive state authorities of the ability to make important decisions – we read in the draft resolution of the Sejm, drawn up by the PiS club.
We know the content of the Sejm’s draft resolution
On Monday, a draft resolution of the Sejm, submitted by the PiS club, was published in the list of parliamentary forms. The project concerns “stopping changes to the Treaty on European Union and the Treaty on the Functioning of the European Union that are dangerous for the Republic of Poland.
The Sejm of the Republic of Poland strongly opposes the proposals for changes to the institutional system of the European Union presented in the report of the Committee on Constitutional Affairs of the European Parliament of 25 October 2023 on changes to the treaties
– we read in the draft resolution. As it was emphasized, the Sejm will at the same time “express support for the presence of the Republic of Poland in the European Union, which is an alliance of cooperating, equal, free and sovereign states.”

“Adopting these proposals would be contrary to the Constitution of the Republic of Poland.
As we read in the project, ‘the proposals in the report (of the EP-PAP committee) lead to depriving the Republic of Poland of the opportunity to independently make important decisions in the areas of foreign policy, defense, border protection, security ( including energy security), home affairs, justice, social policy, monetary policy, tax policy and other areas important from the point of view of state interests.
The Sejm of the Republic of Poland states that the adoption of these proposals would be contrary to the Constitution of the Republic of Poland, and in particular contrary to the principle of the supreme power of the nation, expressed in art. 4 of the Constitution of the Republic of Poland
— it’s written into the project.
The project also commits the Council of Ministers to firmly oppose attempts to amend the Treaty on European Union and the Treaty on the Functioning of the EU to remove powers from Member States, in particular through the application of the principle of unanimity to limit. in the Council and the European Council and reducing the influence of Member States on decision-making processes in the European Union”.
The Sejm of the Republic of Poland obliges the Council of Ministers to ensure that representatives of the Republic of Poland in the Council and the European Council always vote against such amendments.
– added.
The project also addressed the Members of the European Parliament:
The Sejm of the Republic of Poland calls on all Members of the European Parliament – in fulfillment of their constitutional obligations towards the Republic of Poland and the nation – to vote against the adoption of the report of the Committee on Constitutional Affairs of the European Parliament. October 25, 2023 on amendment of treaties
– we are reading.
The Sejm of the Republic of Poland calls on all Members of the European Parliament to take all possible measures to stop changes that limit the sovereignty of the Republic of Poland and its powers in decision-making processes in the European Union
– added.
The Sejm of the Republic of Poland strongly rejects dishonest and untruthful attempts to justify the proposed changes with the alleged need to improve decision-making mechanisms in the European Union, or attempts to present these changes as a precondition for further expansion of the Union.
– we read in the project. As emphasized, “any changes in the EU institutional system that result in the transfer of powers from state authority to the EU institutions require ratification, to which the Sejm and the Senate must agree by a two-thirds majority vote in the presence of at least half the legal number of deputies and senators.”
The justification for the project emphasized that, according to research, “the vast majority of Poles” support the Polish presence in the EU.
In recent years, some EU countries have seen a tendency to transform this organization in a direction that worries a significant part of Polish society
– we are reading. According to the authors of the project, the process of increasing the EU’s powers has so far been carried out through an appropriate interpretation of EU law, including: by the Court of Justice of the European Union.
Although dangerous and disturbing, (this process – PAP) has not yet led to the sudden deprivation of EU countries of their basic powers, and its progress can and can still be stopped
– we are reading.
This state of affairs changed in 2023, when work began on proposals to reform the Treaty on European Union and the Treaty on the Functioning of the European Union. As a result of the work of the European Parliament’s Committee on Constitutional Affairs (AFCO), which began in May, a report was adopted together with a request for further processing of the package of 267 amendments to both treaties.
– we read in the motivation of the project.
According to the authors of the project, “These amendments fundamentally change the institutional system of the European Union and its decision-making mechanisms by abolishing the principle of unanimity (thereby depriving Member States of the right of veto) on a number of important issues.” Of these areas, the authors of the project include the following: defense and foreign policy, border protection. climate and energy policies, as well as internal affairs related to the legal system and monetary and fiscal policies.
For example, according to the authors of the project, adopting individual amendments would allow EU bodies to impose their presence in political alliances with the countries they specify. In turn, other amendments (No. 59-70) would mean that “EU bodies will be able to block the development, expansion and better equipment of the Polish army – for example on the pretext that an oversized Polish army could provoke, with whom the EU wants to maintain good relations.” political and economic relations.
Proposal of 267 amendments to both EU treaties
The European Parliament’s Committee on Constitutional Affairs adopted a report recommending changes to the EU treaties in Wednesday’s vote. The contents of the document were approved by representatives of five factions: the European People’s Party (EPP), Social Democrats (S&D), Liberals (Renew), the Greens and the Left. It contains proposals for 267 amendments to both Treaties – on the European Union and on the functioning of the European Union – and consists of 110 pages.
The main changes proposed are the abolition of the principle of unanimity in EU Council voting in 65 areas and the transfer of powers from Member State level to EU level, including: by creating two new exclusive EU powers – in the field of environmental protection and biodiversity (Article 3 TFEU) – and a significant extension of shared competences (Article 4), which would cover eight new areas: foreign and security policy, border protection, forestry, public health, civil protection, industry and education.
