“The government addressed this some time ago. The bill has been prepared. Due to the period of electoral disruptions, it was not sent to the Sejm. This is an issue that needs to be resolved and dealt with very quickly,” Kosma Złotowski, PiS Member of the European Parliament, tells wPolityce.pl.
When asked whether this is another political complaint that the European Commission has filed against Poland with the Court of Justice of the European Union, he answers that this is not the case.

The European Commission has decided to refer Poland to the Court of Justice of the European Union for “imposing restrictive requirements on companies trading natural gas cross-border under national gas storage regulations.”
Polish law
The Polish Stocks Act imposes an obligation on importers and traders of natural gas stored outside Poland to guarantee at all times the possibility of supplying the total mandatory stocks of natural gas to the national transmission or distribution network and to reserve continuous transmission capacity for Poland, in case the need arises. National law does not allow trading of reserved capacity on the secondary market, even if this capacity is not used. The law also excludes the ‘use-it-or-lose-it’ principle. Gas suppliers using storage facilities in Poland are not subject to the same requirements

According to her, the requirements imposed on importers and traders storing natural gas outside Poland are not in line with EU regulations on security of gas supply because they “impose additional burdens on economic operators storing gas outside Poland, creating a risk of distortion of competition create obstacles to the functioning of the internal market and endanger the security of gas supply.
