The Supreme Court has not allowed the waiver of Judge Maciej Nawacki’s immunity as requested by Judge Paweł Juszczyszyn. “Politicians make the law, not judges. Judges apply the law. There is no crime without a statute,” Zbigniew Korzeniowski, chairman of the jury, said today.
The Supreme Court did not agree to lift Judge Maciej Nawacki’s immunity. Judge Pawel Juszczyszyn demanded this. Judge Zbigniew Korzeniowski at the Supreme Court, who ruled in the case today, referred to the Constitution of the Republic of Poland.
Paweł Juszczyszyn wants to prosecute Maciej Nawacki for allegedly preventing him from delivering a verdict. The decision to suspend the judge was issued by the now defunct Disciplinary Chamber. The court’s decision is invalid.
Justice Korzeniowski’s justification
Supreme Court Judge Zbigniew Korzeniowski justified today’s verdict.
Judge Nawacki recognized the decisions of the Disciplinary Chamber, now we have the Chamber of Professional Responsibility. We have continuity in the trial. The Disciplinary Chamber was a court
– said Judge Korzeniowski, commenting on Juszczyszyn’s statements that he does not recognize the new chamber of the Supreme Court, but appears before it.
Politicians make the law, not judges. Judges apply the law. There is no crime without law. Judge Juszczyszyn was wrong when he concluded that the Disciplinary Chamber is not a court. There is a legal regulation in Poland
– added.
European courts negatively assessed the changes in the Polish judiciary, but the Polish Constitutional Court responded and ruled that European courts ruled outside their powers. The Polish Constitutional Tribunal has primacy. A Polish judge can state that in a conflict situation he accepts the arguments of the Polish Constitutional Tribunal
– emphasized Judge Korzeniowski.
