The European Parliament has taken away the immunities of PiS members, and the basis for this action was to accuse them of incitement to hatred by left-wing activist Rafał Gawł, who was convicted of financial embezzlement in a final judgment in Poland and wanted by the Police. Dominika Wielowieyska, a journalist from ‘Gazeta Wyborcza’, stated in a post on social media that ‘freedom of expression is not the freedom to complain’.
The European Parliament takes away the immunities of PiS members
In a vote during the plenary session, the European Parliament decided to lift the immunity of PiS members of the European Parliament: Beata Kemp, Beata Mazurek, Patryk Jaki and Tomasz Poręba.
The basis was the accusation of four politicians of incitement to hatred by left-wing activist Rafał Gawł, who had been convicted of financial embezzlement in Poland and was wanted by the police.
Rafał Gaweł, who is in Norway, accused politicians of “committing racist crimes in Poland” by retweeting or liking on social media a PiS election spot from the campaign before the 2018 local elections. The spot concerned threats related to the influx of illegal immigrants into Europe.
Gaweł filed additional charges in November 2021 after the prosecutor’s office twice dismissed the charges as unfounded.
Subsequently, a judge in a Warsaw court, a member of the association Iustitia, Edyta Snastin-Jurkun, submitted a request to the European Parliament to waive immunity. Gilles Lebreton, EP rapporteur in the European Parliament’s Legal Affairs Committee, whose job is to advise on such applications, stated that it was politically motivated and recommended its rejection. However, on Tuesday the Legal Affairs Committee voted in favor of the proposal.

Wielowieyska gives lectures on freedom of expression
Dominika Wielowieyska, a journalist from “Gazeta Wyborcza”, posted a message online, probably referring to the situation with the immunity of MEPs. She stated that “freedom of speech is not the freedom to complain.”
