Projects considered by the current opposition parties that aim to reverse changes in the judiciary will have no chance to come into effect – Marek Ast (PiS) told PAP. He recalled that parties seeking to form a government do not have a majority to override the president’s veto.
This is such a threat, but without any real possibility of implementation, at least for the next two years as the president continues in office.

Earlier, KO MP and head of the parliamentary legislative committee, Arkadiusz Myrcha, told PAP, among others, after the last elections. The National Council of the Judiciary, elected in accordance with the Constitution, will verify the appointment of judges.
We are aware of the shortcomings of even thousands of judicial appointments. And this process must be healed. Therefore, verification of judicial appointments will have to take place

Krzysztof Śmiszek from the left, in turn, noted in an interview with PAP that a “profound change to the law on the National Council for the Judiciary” is needed.
We cannot close our eyes to the fact that a body acting contrary to constitutional norms has, in a sense, produced hundreds, and now thousands, of judges whose status can be called into question.

For example, politicians from parties announcing the formation of a future government point to the concepts developed by associations: judges’ associations “Iustitia” and “Themis” and prosecutors’ associations “Lex Super Omnia”.
Almost everything will change in the National Court Register; judges promoted by the current Council will return to their previous positions, and two new chambers of the Supreme Court will be abolished

Ast, chairman of the Justice and Human Rights Committee in the Sejm of the expiring term, pointed out in an interview with PAP that “yes, the opposition can have a majority to pass any laws it can think of, not only in the in the field of justice, but it does not have “there is no way for this qualified majority to override a presidential veto.” He added that “you have to be realistic here.”

As he noted, if there are rational ideas to reform the justice system, they are likely to win the favor not only of the president, but possibly also of PiS.

However, I think that any ideas that concern the legal system and – firstly – will be contrary to the Constitution, and – secondly – will not be in accordance with the direction of the changes previously determined by, under others, the President himself with His draft legal acts will not have any impact and therefore the President’s approval will simply be rejected

Projects with no chance of implementation
According to Asta, the announced projects that “will be aimed at some form of retaliation, the undoing of changes that have been made and that are indisputable – for example, judicial appointments, presidential appointments – will simply have no chance of to come into effect. “
Presidential nominations are sacred. Even if it were possible to point out some shortcomings during the appointment process, which were not there, nevertheless, according to the absolute majority of constitutionalists, the prevailing opinion is that it is the president who ultimately decides and that his appointment affects the position of the judge is final and irrevocable.
