The Austrian Ministry of Justice stated that the country does not have to extradite deserters to Ukraine, as crimes against the established procedure for performing military service are not considered grounds for extradition under the European Extradition Convention. This has been reported TASS.
The publication notes that Article 4 of the document states that extradition may be excluded from the scope of the Convention for military offenses, ie offenses contrary to the order of duty, which are not crimes under ordinary criminal law.
Based on this, the Ministry of Justice emphasized that Austrian judges will use this basis to refuse extradition.
