On Wednesday, the Szczecin court ordered MP Izabela Leszczyna (KO) to publish on TVN24 a correction to the words about Dariusz Matecki (Suwerenna Polska), a candidate for the Sejm from the PiS list, who received “huge money” for the referendum campaign .

At the same time, the court rejected the request of Matecki, a Sejm candidate from the 41st district, to prohibit the “spreading of false information” and to post a correction on x.com (formerly Twitter) and on Facebook. Judge Renata Tarnowska noted that Izabela Leszczyna posted a correction on these portals on Tuesday evening about the content requested by Matecki.
According to Wednesday’s court decision, the rectification must be published on TVN24 no later than 48 hours after the ruling and reads: “The information I provided on September 3, 2023 in the +Kawa na bench+ program on TVN24 The TV station is not true that Mr. Dariusz Matecki has already received a huge amount of money to run the referendum campaign in 2023, despite running for the Sejm of the Republic of Poland.
The statement must be read aloud and at the same time a sign with its text must be displayed, filling the entire screen.

Judge Tarnowska explained that the election request was submitted to the court on Tuesday before 15, and Izabela Leszczyna received it and collected it at approx. 16. Okay. time. 23 issued a statement on x.com and on Facebook admitting the information was untrue.

The request that the entry be published on social networks by October 13 of this year was also not taken into account. This was justified by the fact that content posted online “stays there forever”, thus achieving its purpose.
Matecki also demanded that the rectification be broadcast on TVN24 and TVN before the broadcast of the main number of “Fakty”. The judge pointed out that the false information was made public during a program broadcast on TVN24, so it is appropriate to publish a correction on the same channel so that the potential audience is the same.
The request to award Izabela Leszczyna PLN 50,000 was also rejected. PLN for Caritas Polska. As Judge Tarnowska explained, simply providing false information is not enough; it also takes a violation of personal rights, which the court did not see, nor did Matecki or his lawyer prove this.
During the hearing in this case, Matecki’s lawyer, lawyer Marcin Bury, accepted the application in its entirety, despite Leszczyna’s posting of the correction on social media, noting that the statement was accompanied by the MP’s comment.
Leszczyna added the words: “I admit that my statement in the program + Coffee on the couch + was inaccurate.”

The MP’s representative, Elżbieta Kosińska-Kozak, pointed out that the election law does not prohibit adding comments to the rectification; this is prohibited by the press law, which was not referenced in the application.
The decision of the district court can be appealed within 24 hours.
