The President of the Supreme Medical Council, Łukasz Jankowski, turned to the Prosecutor’s Office, the Office for the Protection of Personal Data, the Ombudsman and the Ombudsman for Patients’ Rights in connection with the entry of the former head of the Ministry of Health, Adam Niedzielski , about a doctor from Poznań and the prescription he issued himself.

The information published by the Supreme Medical Chamber stated that President Jankowski’s speech related to the minister’s violation of personal data provisions by publishing sensitive data about the doctor and the prescription he provided on social media.
In the notification to the public prosecutor’s office about the possibility of committing a crime, the chairman of the NRL ruled, among other things, that the Minister of Health, at the same time, had unlawfully disclosed and used information that he had become aware of in the context of his position. who exceeds his powers as a public officer and acts to the detriment of both private and public.
The doctor has suffered significant damage due to the unlawful actions of the Minister of Health, representing a wide violation of his personal rights and rights guaranteed by the Constitution of the Republic of Poland and EU standards. In the field of public interest, citizens’ trust in the state institution, the Ministry of Health, suffered in particular. Consequently, fulfilling the characteristics of a prohibited act by Adam Niedzielski resulted in an irreversible violation of the principles of a democratic rule of law and violation of legal norms

In addition, in the opinion of the chairman of the NRL, as Minister of Health, he has completely destroyed confidence that data on the health of citizens – patients can be used by a politician for purposes contrary to the very idea of health protection , which presupposes the right to extensive confidentiality of information relating to the health of the person using health services.

By publishing information about the type of medicines that the doctor prescribed himself, the Minister of Health ensured that the data in this area spread through the media and became available to every citizen. At the same time, it should be emphasized that the information about the medicines prescribed by the doctor is of a very special nature, as it relates to his health, privacy and intimacy.

In a statement published on Saturday, the head of the Ministry of Health later announced that the publication of information about the provision of a prescription by a doctor working at a municipal hospital in Poznań was intended, on the one hand, to damage the good name of the Ministry of Health , but above all defending the interests of the patient.
The purpose of disseminating information about the writing of a pro-auctoric prescription by a doctor was the unlawful disclosure of incorrect data, that it would not be possible to write a prescription for medicines from the group of psychopharmaceuticals and analgesics, to counteract. This information, from the national TVN channel, caused patients to fear that they would not be able to get the prescription they were entitled to.

He emphasized that “this required a firm response and removed the patients’ uncertainty seeded by the doctor’s statements.” The minister made a reservation that “no one had access to the data stored in the account of the designated doctor and no one interfered with this account”.
