Judge Dagmara Pawełczyk-Woicka, the head of the national court registry, pointed out in an interview with wPolsce.pl television that the recent CJEU judgment regarding Judge Igor Tuleya is potentially dangerous for the Polish legal order, and the consequences could anarchize the Polish judiciary.

We can see that we are dealing with an encroachment on the question of Polish sovereignty. It is also dangerous for another reason. This decision of the CJEU will not be seriously applied by anyone, except the judges who have asked the CJEU for a preliminary ruling (judges Igor Tuleya Piotr Gąciarek – ed.). I cannot imagine that courts could apply such a guideline, as they would then not feel bound by the rulings of other courts. If they were to investigate whether a decision is a decision in another case and re-examine side issues that another court has already examined, we would have a huge mess. The trials would take even longer. It’s absurd

The beginning of revenge on the judges?
This judgment has been rendered in this case. For me it’s a cabaret situation. I see no point in this decision. It seems to me that this legitimizes the planned actions against former judges of the Disciplinary Chamber of the Supreme Court

According to Judge Dagmara Pawełczyk-Woicka, the ECJ ruling could one day be used as a scare or as a means to attack Supreme Court judges sitting in the Disciplinary Chamber.
I often hear in the media how Prof. Włodzimierz Wróbel of the Supreme Court claims that he respects judicial appointments, but this does not apply to the Disciplinary Chamber. He does not recognize that it was part of the Supreme Court and that the justices of this House enjoyed the same rights as other justices. The judge does not want to undermine all vocations, because that would mean that they too are in danger. Therefore, an instrument was needed that would distinguish the judges appointed by the new composition of the National Judicial Council from the others. Perhaps it is about stripping some judges of their pension rights in the future or removing those who are left from the Supreme Court?
