Judge Tuleya won’t get compensation after ECPS decision? That is what Deputy Minister Sebastian Kaleta claims.
The European Court of Human Rights in Strasbourg agreed with Judge Igor Tuleya, ruling that Poland had violated several articles of the European Convention on Human Rights against him.
The European Court of Human Rights ruled with 6 votes in favor and 1 against that there had been: violation of art. 6 seconds 1 (right to a fair trial) of the European Convention on Human Rights; violation of Article 8 (right to respect for private life). It also ruled unanimously that there had been a violation of Article 10 (freedom of expression)

The court ruled that Poland had to pay Igor Tuleya 30,000 for damages and 6 thousand. for costs and expenses.
Kaleta’s response
The State Secretary of Justice argues that judge Tuleya will not receive the aforementioned money. According to him, the government cannot pay this amount.
I would like to remind the media reporting that Judge Tuleya was awarded €36,000 in “compensation” for the appointment of the Supreme Court ID that the government cannot pay him the declared amount due to the wording of the Constitutional Tribunal (K 7/21), which states that the ECtHR is not competent to judge the lawfulness of judicial appointments in Poland. Therefore, the verdict issued today is not binding on Poland.
